92_SB1550 SRS92SB0046AKcp 1 AN ACT in relation to vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 changing Sections 3-609.1, 3-620, 3-621, 3-622, 3-624, 3-625, 6 3-626, 3-628, 3-638, 3-642, 3-645, 3-647, 3-648 as added by 7 Public Act 92-79, and 3-648 as added by Public Act 92-467 as 8 follows: 9 (625 ILCS 5/3-609.1) (from Ch. 95 1/2, par. 3-609.1) 10 Sec. 3-609.1. Congressional Medal of Honor plates). Any 11 resident of the State of Illinois who has been awarded the 12 Congressional Medal of Honor may make application for the 13 registration of a motor vehicle owned solely or in part by 14 such recipient, to the Secretary of State without the payment 15 of any registration fee. Registration shall be for a 16 multi-year period effective from issuance. The Secretary of 17 State shall furnish at his office at no cost to such 18 Congressional Medal of Honor recipients, plates bearing up to 19 3 letters designating the recipient's initials followed by 20 the letters C M H signifying the Congressional Medal of 21 Honor. The plate shall be suitable for attachment to a motor 22 vehicle or motorcycle, registered under this Code. 23 (Source: P.A. 82-117.) 24 (625 ILCS 5/3-620) (from Ch. 95 1/2, par. 3-620) 25 Sec. 3-620. The Secretary, upon receipt of an 26 application made on the form prescribed by the Secretary of 27 State, may issue special registration plates to United 28 States citizens, who are present or former members of the 29 United States armed forces or any of its allies, and who were 30 prisoners of war of World War I, World War II, the Korean -2- SRS92SB0046AKcp 1 Conflict, and the Vietnamese conflict, or to the widowed 2 spouse of a former member of the United States armed forces, 3 providing that widowed spouse was married to the POW at the 4 time of death, and is a single person at the time of 5 application. The special plates issued pursuant to this 6 Section shall be affixed only to passenger vehicles of the 7 first division or motorcycles, subject to the staggered 8 registration system and vehicles of the second division 9 having a gross weight of 8,0008000pounds or less and shall 10 be issued without charge. Only one set of plates may be 11 issued at no fee. 12 The design and color of the prisoner of war plates shall 13 be wholly within the discretion of the Secretary of State. 14 (Source: P.A. 84-1308.) 15 (625 ILCS 5/3-621) (from Ch. 95 1/2, par. 3-621) 16 Sec. 3-621. The Secretary, upon receipt of an 17 application, made in the form prescribed by the Secretary of 18 State, may issue to members of the Illinois National Guard, 19 special registration plates. The special plates issued 20 pursuant to this Section shall be affixed only to passenger 21 vehicles of the first division, motorcycles, or motor 22 vehicles of the second division weighing not more than 8,000 23 pounds subject to the staggered registration system. 24 The design and color of such plates shall be wholly 25 within the discretion of the Secretary of State. 26 (Source: P.A. 84-986.) 27 (625 ILCS 5/3-622) (from Ch. 95 1/2, par. 3-622) 28 Sec. 3-622. The Secretary, upon receipt of an 29 application made in the form prescribed by the Secretary of 30 State, may issue to members of the United States Armed Forces 31 Reserves who reside in Illinois, special registration plates. 32 The special plates issued pursuant to this Section shall be -3- SRS92SB0046AKcp 1 affixed only to passenger vehicles of the first division or 2 motor vehicles of the second division, motorcycles, weighing 3 not more than 8,000 pounds subject to the staggered 4 registration system. The design and color of such plates 5 shall be wholly within the discretion of the Secretary of 6 State. 7 (Source: P.A. 84-986.) 8 (625 ILCS 5/3-624) (from Ch. 95 1/2, par. 3-624) 9 Sec. 3-624. The Secretary, upon receipt of an 10 application made in the form prescribed by the Secretary of 11 State, may issue to retired members of the United States 12 Armed Forces who reside in Illinois, special registration 13 plates. The special plates issued pursuant to this Section 14 shall be affixed only to passenger vehicles of the first 15 division, motorcycles, or motor vehicles of the second 16 division weighing not more than 8,000 pounds and subject to 17 the staggered registration system. The design and color of 18 such plates shall be wholly within the discretion of the 19 Secretary of State. 20 (Source: P.A. 86-165.) 21 (625 ILCS 5/3-625) (from Ch. 95 1/2, par. 3-625) 22 Sec. 3-625. Pearl Harbor Plates. The Secretary, upon 23 receipt of an application made in the form prescribed by the 24 Secretary of State, may issue special registration plates to 25 any Illinois resident who, while a member of the armed forces 26 of the United States, participated in the battle of Pearl 27 Harbor on December 7, 1941, or to the widowed spouse of any 28 Illinois resident who, while a member of the armed forces of 29 the United States, participated in the battle of Pearl Harbor 30 on December 7, 1941, provided that the widowed spouse was 31 married to the battle of Pearl Harbor participant at the time 32 of the participant's death and is a single person at the time -4- SRS92SB0046AKcp 1 of application. The special plates issued pursuant to this 2 Section should be affixed only to passenger vehicles of the 3 1st division, motorcycles, or motor vehicles of the 2nd 4 division weighing not more than 8,000 pounds. 5 The design and color of such plates shall be wholly 6 within the discretion of the Secretary of State. Appropriate 7 documentation, as determined by the Secretary, and the 8 standard registration fee shall accompany the application. 9 (Source: P.A. 89-571, eff. 7-26-96; 89-620, eff. 1-1-97.) 10 (625 ILCS 5/3-626) 11 Sec. 3-626. Korean War Veteran license plates. 12 (a) In addition to any other special license plate, the 13 Secretary, upon receipt of all applicable fees and 14 applications made in the form prescribed by the Secretary of 15 State, may issue special registration plates designated as 16 Korean War Veteran license plates to residents of Illinois 17 who participated in the United States Armed Forces during the 18 Korean War. The special plate issued under this Section 19 shall be affixed only to passenger vehicles of the first 20 division, motorcycles, motor vehicles of the second division 21 weighing not more than 8,000 pounds, and recreational 22 vehicles as defined by Section 1-169 of this Code. Plates 23 issued under this Section shall expire according to the 24 staggered multi-year procedure established by Section 3-414.1 25 of this Code. 26 (b) The design, color, and format of the plates shall be 27 wholly within the discretion of the Secretary of State. The 28 Secretary may, in his or her discretion, allow the plates to 29 be issued as vanity plates or personalized in accordance with 30 Section 3-405.1 of this Code. The plates are not required to 31 designate "Land Of Lincoln", as prescribed in subsection (b) 32 of Section 3-412 of this Code. The Secretary shall prescribe 33 the eligibility requirements and, in his or her discretion, -5- SRS92SB0046AKcp 1 shall approve and prescribe stickers or decals as provided 2 under Section 3-412. 3 (c) An applicant shall be charged a $15 fee for original 4 issuance in addition to the applicable registration fee. Of 5 this additional fee, $13 shall be deposited into the 6 Secretary of State Special License Plate Fund and $2 shall be 7 deposited into the Korean War Memorial Construction Fund. 8 For each registration renewal period, a $2 fee, in addition 9 to the appropriate registration fee, shall be charged and 10 shall be deposited into the Secretary of State Special 11 License Plate Fund. 12 (d) The Korean War Memorial Construction Fund is created 13 as a special fund in the State treasury. All moneys in the 14 Korean War Memorial Construction Fund shall, subject to 15 appropriation, be used by the Department of Veteran Affairs 16 to provide grants for construction of the Korean War Memorial 17 to be located at Oak Ridge Cemetery in Springfield, Illinois. 18 Upon the completion of the Memorial, the Department of 19 Veteran Affairs shall certify to the State Treasurer that the 20 construction of the Memorial has been completed. Upon the 21 certification by the Department of Veteran Affairs, the State 22 Treasurer shall transfer all moneys in the Fund and any 23 future deposits into the Fund into the Secretary of State 24 Special License Plate Fund. 25 (e) An individual who has been issued Korean War Veteran 26 license plates for a vehicle and who has claimed and received 27 a grant under the Senior Citizens and Disabled Persons 28 Property Tax Relief and Pharmaceutical Assistance Act shall 29 pay the original issuance and the regular annual fee for the 30 registration of the vehicle as provided in Section 3-806.3 of 31 this Code in addition to the fees specified in subsection (c) 32 of this Section. 33 (Source: P.A. 91-679, eff. 1-26-00.) -6- SRS92SB0046AKcp 1 (625 ILCS 5/3-628) 2 Sec. 3-628. Bronze Star plates. 3 (a) Beginning January 1, 1996, in addition to any other 4 special license plate, the Secretary, upon receipt of all 5 applicable fees and applications made in the form prescribed 6 by the Secretary of State, may issue special registration 7 plates to residents of Illinois who have been awarded the 8 Bronze Star by the United States Armed Forces. The special 9 plate issued under this Section shall be affixed only to 10 passenger vehicles of the first division, motorcycles, or 11 motor vehicles of the second division weighing not more than 12 8,000 pounds. Plates issued under this Section shall expire 13 according to the staggered multi-year procedure established 14 by Section 3-414.1 of this Code. 15 (b) The design, color, and format of the plates shall be 16 wholly within the discretion of the Secretary of State. The 17 Secretary may, in his or her discretion, allow the plates to 18 be issued as vanity plates or personalized in accordance with 19 Section 3-405.1 of this Code. The plates are not required to 20 designate "Land Of Lincoln", as prescribed in subsection (b) 21 of Section 3-412 of this Code. The Secretary shall prescribe 22 the eligibility requirements and, in his or her discretion, 23 shall approve and prescribe stickers or decals as provided 24 under Section 3-412. 25 (c) An applicant shall be charged a $15 fee for original 26 issuance in addition to the appropriate registration fee. 27 This additional fee shall be deposited into the Secretary 28 of State Special License Plate Fund. For each registration 29 renewal period, a $2 fee, in addition to the appropriate 30 registration fee, shall be charged and deposited into the 31 Secretary of State Special License Plate Fund. 32 (Source: P.A. 88-589, eff. 8-14-94; 89-282, eff. 8-10-95.) 33 (625 ILCS 5/3-638) -7- SRS92SB0046AKcp 1 Sec. 3-638. U.S. Veteran License Plates. 2 (a) In addition to any other special license plate, the 3 Secretary, upon receipt of all applicable fees and 4 applications made in the form prescribed by the Secretary of 5 State, may issue U.S. Veteran license plates to residents of 6 Illinois who meet eligibility requirements prescribed by the 7 Secretary of State. The special U.S. Veteran plate issued 8 under this Section shall be affixed only to passenger 9 vehicles of the first division, motorcycles, and motor 10 vehicles of the second division weighing not more than 8,000 11 pounds. Plates issued under this Section shall expire 12 according to the staggered multi-year procedure established 13 by Section 3-414.1 of this Code. 14 (b) The design, color, and format of the plates shall be 15 wholly within the discretion of the Secretary of State. The 16 Secretary may, in his or her discretion, allow the plates to 17 be issued as vanity plates or personalized in accordance with 18 Section 3-405.1 of this Code. The plates are not required to 19 designate "Land Of Lincoln", as prescribed in subsection (b) 20 of Section 3-412 of this Code. Silver Star plates. -8- SRS92SB0046AKcp 1 (a) The Secretary, upon receipt of all applicable fees 2 and applications made in the form prescribed by the 3 Secretary, may issue special registration plates to residents 4 of Illinois who have been awarded the Silver Star by the 5 United States Armed Forces. The special plate issued under 6 this Section shall be affixed only to passenger vehicles of 7 the first division, motorcycles, or motor vehicles of the 8 second division weighing not more than 8,000 pounds. Plates 9 issued under this Section shall expire according to the 10 staggered multi-year procedure established by Section 3-414.1 11 of this Code. 12 (b) The design, color, and format of the plates shall be 13 wholly within the discretion of the Secretary. The Secretary 14 may, in his or her discretion, allow the plates to be issued 15 as vanity plates or personalized in accordance with Section 16 3-405.1 of this Code. The plates are not required to 17 designate "Land Of Lincoln", as prescribed in subsection (b) 18 of Section 3-412 of this Code. The Secretary shall prescribe 19 the eligibility requirements and, in his or her discretion, 20 shall approve and prescribe stickers or decals as provided 21 under Section 3-412. 22 (c) An applicant shall be charged a $15 fee for original 23 issuance in addition to the appropriate registration fee. 24 This additional fee shall be deposited into the Secretary 25 of State Special License Plate Fund. For each registration 26 renewal period, a $2 fee, in addition to the appropriate 27 registration fee, shall be charged and deposited into the 28 Secretary of State Special License Plate Fund. 29 (Source: P.A. 90-533, eff. 11-14-97; 90-655, eff. 7-30-98.) 30 (625 ILCS 5/3-645) 31 Sec. 3-645. Vietnam Veteran License Plates. 32 (a) In addition to any other special license plate, the 33 Secretary, upon receipt of all applicable fees and -9- SRS92SB0046AKcp 1 applications made in the form prescribed by the Secretary of 2 State, may issue Vietnam Veteran license plates to residents 3 of Illinois who meet eligibility requirements prescribed by 4 the Secretary of State. The special Vietnam Veteran plate 5 issued under this Section shall be affixed only to passenger 6 vehicles of the first division, motorcycles, and motor 7 vehicles of the second division weighing not more than 8,000 8 pounds. Plates issued under this Section shall expire 9 according to the staggered multi-year procedure established 10 by Section 3-414.1 of this Code. 11 (b) The design, color, and format of the plates shall be 12 wholly within the discretion of the Secretary of State. The 13 Secretary may, in his or her discretion, allow the plates to 14 be issued as vanity plates or personalized in accordance with 15 Section 3-405.1 of this Code. The plates are not required to 16 designate "Land Of Lincoln", as prescribed in subsection (b) 17 of Section 3-412 of this Code. World War II Veteran License Plates. 31 (a) In addition to any other special license plate, the 32 Secretary, upon receipt of all applicable fees and 33 applications made in the form prescribed by the Secretary of -10- SRS92SB0046AKcp 1 State, may issue World War II Veteran license plates to 2 residents of Illinois who meet eligibility requirements 3 prescribed by the Secretary of State. The special World War 4 II Veteran plate issued under this Section shall be affixed 5 only to passenger vehicles of the first division, 6 motorcycles, and motor vehicles of the second division 7 weighing not more than 8,000 pounds. Plates issued under this 8 Section shall expire according to the staggered multi-year 9 procedure established by Section 3-414.1 of this Code. 10 (b) The design, color, and format of the plates shall be 11 wholly within the discretion of the Secretary of State. The 12 Secretary may, in his or her discretion, allow the plates to 13 be issued as vanity plates or personalized in accordance with 14 Section 3-405.1 of this Code. The plates are not required to 15 designate "Land Of Lincoln", as prescribed in subsection (b) 16 of Section 3-412 of this Code. The Secretary shall prescribe 17 the eligibility requirements and, in his or her discretion, 18 shall approve and prescribe stickers or decals as provided 19 under Section 3-412. 20 (c) An applicant shall be charged a $15 fee for original 21 issuance in addition to the applicable registration fee. 22 This additional fee shall be deposited into the Secretary of 23 State Special License Plate Fund. For each registration 24 renewal period, a $2 fee, in addition to the appropriate 25 registration fee, shall be charged and shall be deposited 26 into the Secretary of State Special License Plate Fund. 27 (Source: P.A. 91-805, eff. 1-1-01.) 28 (625 ILCS 5/3-650) 29 Sec. 3-650.3-648.Army Combat Veteran license plates. 30 (a) In addition to any other special license plate, the 31 Secretary, upon receipt of all applicable fees and 32 applications made in the form prescribed by the Secretary of 33 State, may issue Army Combat Veteran license plates to -11- SRS92SB0046AKcp 1 residents of Illinois who meet eligibility requirements 2 prescribed by the Secretary of State. The special Army 3 Combat Veteran plate issued under this Section shall be 4 affixed only to passenger vehicles of the first division, 5 motorcycles, and motor vehicles of the second division 6 weighing not more than 8,000 pounds. Plates issued under this 7 Section shall expire according to the staggered multi-year 8 procedure established by Section 3-414.1 of this Code. 9 (b) The plates shall display the Army Combat Infantry 10 Badge. In all other respects, the design, color, and format 11 of the plates shall be within the discretion of the Secretary 12 of State. The Secretary may, in his or her discretion, allow 13 the plates to be issued as vanity plates or personalized in 14 accordance with Section 3-405.1 of this Code. The plates are 15 not required to designate "Land Of Lincoln", as prescribed in 16 subsection (b) of Section 3-412 of this Code. The Secretary 17 shall prescribe the eligibility requirements and, in his or 18 her discretion, shall approve and prescribe stickers or 19 decals as provided under Section 3-412. 20 (c) An applicant shall be charged a $15 fee for original 21 issuance in addition to the applicable registration fee. 22 This additional fee shall be deposited into the Secretary of 23 State Special License Plate Fund. For each registration 24 renewal period, a $2 fee, in addition to the appropriate 25 registration fee, shall be charged and shall be deposited 26 into the Secretary of State Special License Plate Fund. 27 (Source: P.A. 92-79, eff. 1-1-02; revised 10-17-01.) 28 (625 ILCS 5/3-651) 29 Sec. 3-651.3-648.U.S. Marine Corps license plates. 30 (a) In addition to any other special license plate, the 31 Secretary, upon receipt of all applicable fees and 32 applications made in the form prescribed by the Secretary of 33 State, may issue special registration plates designated as -12- SRS92SB0046AKcp 1 U.S. Marine Corps license plates to residents of Illinois who 2 meet eligibility requirements prescribed by the Secretary of 3 State. The special plate issued under this Section shall be 4 affixed only to passenger vehicles of the first division, 5 motorcycles, motor vehicles of the second division weighing 6 not more than 8,000 pounds, and recreational vehicles as 7 defined by Section 1-169 of this Code. Plates issued under 8 this Section shall expire according to the staggered 9 multi-year procedure established by Section 3-414.1 of this 10 Code. 11 (b) The design, color, and format of the plates shall be 12 wholly within the discretion of the Secretary of State, 13 except that the U.S. Marine Corps emblem shall appear on the 14 plates. The Secretary may, in his or her discretion, allow 15 the plates to be issued as vanity or personalized plates in 16 accordance with Section 3-405.1 of this Code. The plates are 17 not required to designate "Land Of Lincoln", as prescribed in 18 subsection (b) of Section 3-412 of this Code. The Secretary 19 shall prescribe the eligibility requirements and, in his or 20 her discretion, shall approve and prescribe stickers or 21 decals as provided under Section 3-412. 22 (c) An applicant shall be charged a $20 fee for original 23 issuance in addition to the applicable registration fee. Of 24 this additional fee, $15 shall be deposited into the 25 Secretary of State Special License Plate Fund and $5 shall be 26 deposited into the Marine Corps Scholarship Fund. For each 27 registration renewal period, a $20 fee, in addition to the 28 appropriate registration fee, shall be charged. Of this 29 additional fee, $2 shall be deposited into the Secretary of 30 State Special License Plate Fund and $18 shall be deposited 31 into the Marine Corps Scholarship Fund. 32 (d) The Marine Corps Scholarship Fund is created as a 33 special fund in the State treasury. All moneys in the Marine 34 Corps Scholarship Fund shall, subject to appropriation by the -13- SRS92SB0046AKcp 1 General Assembly and approval by the Secretary, be used by 2 the Marine Corps Scholarship Foundation, Inc., a recognized 3 charitable organization that meets the requirements of Title 4 26, Section 501(c)(3) of the United States Code, to provide 5 grants for scholarships for higher education. The scholarship 6 recipients must be the children of current or former members 7 of the United States Marine Corps who meet the academic, 8 financial, and other requirements established by the Marine 9 Corps Scholarship Foundation. In addition, the recipients 10 must be Illinois residents and must attend a college or 11 university located within the State of Illinois. 12 The State Treasurer shall require the Marine Corps 13 Scholarship Foundation to establish a separate account for 14 receipt of the proceeds of the Marine Corps Scholarship Fund. 15 That account shall be subject to audit either annually or at 16 another interval, as determined by the State Treasurer. 17 Proceeds from the Marine Corps Scholarship Fund shall be 18 transferred on a quarterly basis by the State Treasurer's 19 office to this separate account. 20 (Source: P.A. 92-467, eff. 1-1-02; revised 10-17-01.) 21 Section 99. Effective date. This Act takes effect upon 22 becoming law.
