92_SB1588ham005 LRB9211354DHmbam04 1 AMENDMENT TO SENATE BILL 1588 2 AMENDMENT NO. . Amend Senate Bill 1588 on page 1, by 3 replacing lines 4 through 8 with the following: 4 "Section 5. The Illinois Vehicle Code is amended by 5 changing Section 3-600 and adding Section 3-654 as follows: 6 (625 ILCS 5/3-600) (from Ch. 95 1/2, par. 3-600) 7 Sec. 3-600. Requirements for issuance of special plates. 8 (a) The Secretary of State shall not issue a series of 9 special plates that the General Assembly has authorized for 10 issuance before the effective date of this amendatory Act of 11 the 92nd General Assembly unless applications, as prescribed 12 by the Secretary, have been received for 10,000 plates of 13 that series; except that the Secretary of State may prescribe 14 some other required number of applications if that number is 15 sufficient to pay for the total cost of designing, 16 manufacturing and issuing the special license plate. 17 (a-1) The Secretary of State may issue a series of 18 special plates that the General Assembly has authorized for 19 issuance on or after the effective date of this amendatory 20 Act of the 92nd General Assembly only if the organization 21 seeking issuance of the plates either has deposited with the 22 Secretary in cash an amount the Secretary has determined to -2- LRB9211354DHmbam04 1 be sufficient to cover the cost of designing, manufacturing, 2 and issuing 1,500 sets of the special plates or has provided 3 the Secretary with a performance bond guaranteeing payment of 4 the required amount if necessary. If no formal organization 5 exists at the time that issuance of the special plates is 6 proposed, the individual or individuals seeking issuance of 7 the plates must form an organization to deposit the required 8 moneys or post the required bond. 9 The amount deposited with the Secretary, or any proceeds 10 from redemption of the performance bond, shall be deposited 11 into the Secretary of State Special License Plate Fund. 12 (a-2) Within 3 years after the date on which issuance of 13 special plates under subsection (a-1) is first authorized, 14 the Secretary of State must receive applications for at least 15 1,500 sets of the special plates. If the required number of 16 applications is received within the 3-year period, the 17 Secretary shall return the amount of any cash deposit and 18 shall retain any interest realized on the principal. If the 19 required number of applications is not received within the 20 3-year period, the Secretary shall recall the special plates. 21 This subsection (a-2) does not apply to plates for which 22 applicants must meet specified eligibility requirements. 23 (a-3) Within 3 years after the effective date of this 24 amendatory Act of the 92nd General Assembly, the Secretary of 25 State must have received applications for a total of at least 26 1,500 sets of every series of special plates that were issued 27 under subsection (a), except those special plates for which 28 the applicant must meet specified eligibility requirements. 29 If the required number of applications has not been received 30 within the 3-year period, the Secretary shall recall the 31 special plates. 32 (b) The Secretary of State, upon issuing a new series of 33 special license plates, shall notify all law enforcement 34 officials of the design, color and other special features of -3- LRB9211354DHmbam04 1 the special license plate series. 2 (c) This Section shall not apply to special license 3 plate categories in existence on the effective date of this 4 amendatory Act of 1990, or to the Secretary of State's 5 discretion as established in Section 3-611. 6 (Source: P.A. 86-1207.) 7 (625 ILCS 5/3-654 new) 8 Sec. 3-654. Emergency Medical Technicians and Paramedics 9 license plates."; and 10 on page 2, below line 7, by inserting the following: 11 "Section 99. Effective date. This Act takes effect upon 12 becoming law.".
