92_SB1605 LRB9211351BDdv 1 AN ACT concerning disabilities. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Mental Health and Developmental 5 Disabilities Administrative Act is amended by changing 6 Section 15.2 as follows: 7 (20 ILCS 1705/15.2) (from Ch. 91 1/2, par. 100-15.2) 8 Sec. 15.2. Quality Assurance for Adult Developmental 9 Training Services. Whenever the Department of Public Aid or 10 the Department of Human Services pays the cost, directly or 11 indirectly, in whole or part, for adult developmental 12 training day services for persons with developmental 13 disabilities, the provider of such services shall meet 14 minimum standards established by the Department. Such 15 minimum standards shall become effective July 1, 1986. 16 Interim program guidelines, established by the Department, 17 shall be utilized for programs operational prior to July 1, 18 1985. 19 Once every 3 years, the Department shallannuallycertify 20 that adult developmental training day services providers meet 21 minimum standards. The Department may determine that 22 providers accredited under nationally recognized 23 accreditation programs are deemed to have met the standards 24 established by the Department under this Section. The 25 Department shall, at least quarterly, review the services 26 being provided to assure compliance with the standards. The 27 Department may suspend, refuse to renew or deny certification 28 to any provider who fails to meet any or all such standards, 29 as provided by rule. 30 For purposes of this Section, "adult developmental 31 training day service" means services designed to help persons -2- LRB9211351BDdv 1 with developmental disabilities to develop functional skills 2 for living in such areas as motoric development, dressing and 3 grooming, toileting, eating, language, reading and writing, 4 quantitative skills development, independent living and 5 reduction of maladaptive behavior. Such programs may include 6 services designed to improve an individual's ability to 7 engage in productive work as defined for work activity 8 centers in the federal Fair Labor Standards Act, as amended. 9 For purposes of this Section, "providers of adult 10 developmental training day services" means any person, agency 11 or organization that provides such services for persons with 12 developmental disabilities as defined by the Mental Health 13 and Developmental Disabilities Code. 14 (Source: P.A. 89-507, eff. 7-1-97.)
