92_SB1704ham001 LRB9211321RCpkam 1 AMENDMENT TO SENATE BILL 1704 2 AMENDMENT NO. . Amend Senate Bill 1704 on page 1, by 3 inserting between lines 3 and 4 the following: 4 "Section 2. The Illinois Municipal Code is amended by 5 adding Section 1-4-5.1 as follows: 6 (65 ILCS 5/1-4-5.1 new) 7 Sec. 1-4-5.1. Aid or assistance of peace officers from 8 other jurisdictions. Whenever a member of a police 9 department of a unit of local government with a population 10 greater than 500,000 inhabitants requests aid or assistance 11 or provides aid or assistance under clause (3) of subsection 12 (a-3) of Section 107-4 of the Code of Criminal Procedure of 13 1963, the unit of local government on whose behalf the 14 request is made shall hold harmless, indemnify, and defend 15 the police officer and his or her employer against all 16 claims, demands, liability, losses, and suits in law or 17 equity made by a third party, including any liability or 18 obligation to indemnify created by Section 1-4-5 or 1-4-6 of 19 this Code, arising out of the aid or assistance that is 20 provided unless otherwise agreed. The unit of local 21 government requesting assistance shall waive all claims 22 against the police officer or his or her employer arising out -2- LRB9211321RCpkam 1 of the aid or assistance that is provided under clause (3) of 2 subsection (a-3) of Section 107-4 of the Code of Criminal 3 Procedure of 1963 other than claims resulting from willful 4 and wanton misconduct.".
