 1        AN ACT concerning ethanol.

 2        Be it  enacted  by  the  People  of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Energy Conservation and Coal  Development
 5    Act is amended by changing Section 3 as follows:

 6        (20 ILCS 1105/3) (from Ch. 96 1/2, par. 7403)
 7        Sec. 3.  Powers and Duties.
 8        (a)  In  addition to its other powers, the Department has
 9    the following powers:
10             (1)  To administer for the State any energy programs
11        and  activities  under  federal   law,   regulations   or
12        guidelines,   and   to   coordinate   such  programs  and
13        activities with other  State  agencies,  units  of  local
14        government, and  educational institutions.
15             (2)  To   represent  the  State  in  energy  matters
16        involving the federal government, other states, units  of
17        local government, and regional agencies.
18             (3)  To   prepare   energy   contingency  plans  for
19        consideration by the Governor and the  General  Assembly.
20        Such  plans shall include procedures for determining when
21        a  foreseeable  danger  exists   of   energy   shortages,
22        including  shortages  of  petroleum, coal, nuclear power,
23        natural gas, and other forms of energy, and shall specify
24        the actions to be taken to minimize hardship and maintain
25        the general welfare during such energy shortages.
26             (4)  To   cooperate   with   State   colleges    and
27        universities   and   their  governing  boards  in  energy
28        programs and activities.
29             (5)  (Blank).
30             (6)  To accept,  receive,  expend,  and  administer,
31        including   by   contracts  and  grants  to  other  State

 1        agencies, any energy-related gifts,  grants,  cooperative
 2        agreement  funds,  and  other funds made available to the
 3        Department by the federal government and other public and
 4        private sources.
 5             (7)  To investigate  practical  problems,  seek  and
 6        utilize   financial  assistance,  implement  studies  and
 7        conduct research relating to the production, distribution
 8        and use of alcohol fuels.
 9             (8)  To serve as a clearinghouse for information  on
10        alcohol   production   technology;   provide  assistance,
11        information and data relating to the production  and  use
12        of  alcohol; develop informational packets and brochures,
13        and hold public seminars to encourage the development and
14        utilization of the best available technology.
15             (9)  To coordinate  with  other  State  agencies  in
16        order  to  promote the maximum flow of information and to
17        avoid unnecessary overlapping of alcohol  fuel  programs.
18        In  order  to  effectuate  this goal, the Director of the
19        Department or his representative shall consult  with  the
20        Directors,  or  their representatives, of the Departments
21        of    Agriculture,    Central    Management     Services,
22        Transportation, and Revenue, the Office of the State Fire
23        Marshal, and the Environmental Protection Agency.
24             (10)  To  operate,  within the Department, an Office
25        of Coal Development and Marketing for the  promotion  and
26        marketing   of   Illinois   coal  both  domestically  and
27        internationally.    The   Department   may   use   monies
28        appropriated   for    this    purpose    for    necessary
29        administrative expenses.
30             The  Office  of Coal Development and Marketing shall
31        develop and implement an initiative to  assist  the  coal
32        industry  in  Illinois  to  increase  its  share  of  the
33        international coal market.
34             (11)  To assist the Department of Central Management

 1        Services  in  establishing  and  maintaining  a system to
 2        analyze  and  report  energy  consumption  of  facilities
 3        leased by the Department of Central Management Services.
 4             (12)  To consult with  the  Departments  of  Natural
 5        Resources    and    Transportation   and   the   Illinois
 6        Environmental  Protection  Agency  for  the  purpose   of
 7        developing  methods  and  standards  that  encourage  the
 8        utilization of coal combustion by-products as value added
 9        products in productive and benign applications.
10             (13)  To    provide    technical    assistance   and
11        information to sellers and distributors  of  storage  hot
12        water  heaters  doing  business  in Illinois, pursuant to
13        Section 1 of the Hot Water Heater Efficiency Act.
14        (b)  (Blank).
15        (c)  (Blank).
16        (d)  The  Department   shall   develop   a   package   of
17    educational   materials  regarding  the  necessity  of  waste
18    reduction and recycling to reduce dependence on landfills and
19    to maintain environmental quality.  The  materials  developed
20    shall be suitable for instructional use in grades 3, 4 and 5.
21    The  Department  shall distribute such instructional material
22    to all public elementary and unit school districts  no  later
23    than November 1, of each year.
24        (e)  The   Department  shall  study  the  feasibility  of
25    requiring that wood  and  sawdust  from  construction  waste,
26    demolition   projects,   sawmills,   or   other  projects  or
27    industries where wood is used in a large amount  be  shredded
28    and  composted,  and  that such wood be prohibited from being
29    disposed of in a landfill.  The Department shall  report  the
30    results  of  this study to the General Assembly by January 1,
31    1991.
32        (f)  (Blank).
33        (g)  The Department shall develop a program designated to
34    encourage the recycling of outdated telephone directories and

 1    to encourage the printing  of  new  directories  on  recycled
 2    paper.    The  Department  shall  work  in  conjunction  with
 3    printers   and   distributors   of   telephone    directories
 4    distributed  in  the State to provide them with any technical
 5    assistance available in their efforts to procure  appropriate
 6    recycled   paper.    The   Department  shall  also  encourage
 7    directory distributors to pick  up  outdated  directories  as
 8    they  distribute  new  ones, and shall assist any distributor
 9    who is willing to do so in  finding  a  recycler  willing  to
10    purchase the old directories and in publicizing and promoting
11    with  citizens  of  the  area  the  distributor's  collection
12    efforts and schedules.
13        (h)  The  Department  shall  assist,  cooperate  with and
14    provide necessary staff and  resources  for  the  Interagency
15    Energy  Conservation Committee, which shall be chaired by the
16    Director of the Department.
17        (i)  (Blank). The  Department  shall  operate  or  manage
18    within  or  outside  of  the  Department  a  corn  to ethanol
19    research facility for the purpose of reducing  the  costs  of
20    producing     ethanol    through    the    development    and
21    commercialization of new production technologies,  equipment,
22    processes,  feedstocks,  and  new value added co-products and
23    by-products.  This work shall be conducted under  the  review
24    and  guidance of the Illinois Ethanol Research Advisory Board
25    chaired by the  Director  of  the  Department.   The  ethanol
26    production research shall be conducted at the Corn to Ethanol
27    Research   Pilot  Plant  in  cooperation  with  universities,
28    industry, other State agencies, and the federal government.

32        Section 10.  The Energy Conservation and Coal Development
33    Act is amended by repealing Section 8a.

 1        Section 15.  The Southern Illinois University  Management
 2    Act is amended by adding Sections 6.5 and 6.6 as follows:

 3        (110 ILCS 520/6.5 new)
 4        Sec.  6.5.  Corn to ethanol.  The Board shall operate and
 5    manage the National Corn-to-Ethanol Research Pilot Plant  for
 6    the  purpose  of  reducing  the  costs  of  producing ethanol
 7    through  the  development  and   commercialization   of   new
 8    production  technologies,  equipment,  processes, feedstocks,
 9    and new value added co-products and by-products.   This  work
10    shall  be  conducted  under  the  review  and guidance of the
11    Illinois  Ethanol  Research  Advisory  Board.    The  ethanol
12    production  research  shall  be  conducted  at  the  National
13    Corn-to-Ethanol Research  Pilot  Plant  in  cooperation  with
14    other universities, industry, State agencies, and the federal
15    government.

17        Sec. 6.6.  The Illinois Ethanol Research Advisory Board.
18        (a)  There  is  established the Illinois Ethanol Research
19    Advisory Board (the "Advisory Board").
20        (b)  The Advisory Board shall be composed of  13  members
21    including:  the President of Southern Illinois University who
22    shall be Chairman; the Director  of  Commerce  and  Community
23    Affairs;  the  Director  of Agriculture; the President of the
24    Illinois Corn  Growers  Association;  the  President  of  the
25    National  Corn  Growers  Association;  the  President  of the
26    Renewable Fuels Association;  the  Dean  of  the  College  of
27    Agricultural, Consumer, and Environmental Science, University
28    of  Illinois  at  Champaign-Urbana;  and  6  at-large members
29    appointed by the Governor representing the ethanol  industry,
30    growers, suppliers, and universities.
31        (c)  The  6  at-large  members  shall  serve  a term of 4
32    years.  The Advisory Board shall meet at least annually or at

 1    the call of the Chairman.  At any  time  a  majority  of  the
 2    Advisory Board may petition the Chairman for a meeting of the
 3    Board.   Seven members of the Advisory Board shall constitute
 4    a quorum.
 5        (d)  The Advisory Board shall:
 6             (1)  Review the annual operating plans and budget of
 7        the National Corn-to-Ethanol Research Pilot Plant.
 8             (2)  Advise on research and  development  priorities
 9        and  projects  to  be  carried out at the Corn-to-Ethanol
10        Research Pilot Plant.
11             (3)  Advise on policies and procedures regarding the
12        management and operation of the  ethanol  research  pilot
13        plant.   This  may  include contracts, project selection,
14        and personnel issues.
15             (4)  Develop bylaws.
16             (5)  Submit a  final  report  to  the  Governor  and
17        General    Assembly    outlining    the    progress   and
18        accomplishments  made  during  the  year  along  with   a
19        financial report for the year.
20        (e)  The  Advisory Board established by this Section is a
21    continuation,  as  changed  by  the  Section,  of  the  Board
22    established under Section 8a of the Energy  Conservation  and
23    Coal  Act  and  repealed  by  this amendatory Act of the 92nd
24    General Assembly.

25        Section 99.  Effective date.  This Act takes effect  upon
26    becoming law.
