92_SJ0017 LRB9201416KBkbC 1 SENATE JOINT RESOLUTION 2 WHEREAS, The General Assembly, as a matter of public 3 policy, rejects any form of enforcement action based solely 4 upon race, ethnicity, religion, sex, or sexual preference, 5 particularly as it may relate to enforcement of the Illinois 6 vehicle and criminal laws; and 7 WHEREAS, The procedures used by police while enforcing 8 the Illinois vehicle and criminal laws are of utmost 9 importance to the safety and well-being of all Illinoisans; 10 and 11 WHEREAS, It is in the best interest of the people of the 12 State of Illinois to have all police officers thoroughly 13 trained in the proper procedures which should be employed 14 while enforcing Illinois vehicle and criminal laws; and 15 WHEREAS, The law enforcement term "criminal profiling" 16 has been confused with the term "racial profiling" or "biased 17 enforcement"; and 18 WHEREAS, The General Assembly recognizes that although 19 "criminal profiling" is a proven and legitimate law 20 enforcement technique using behavioral characteristics and 21 other factors and identifiers to investigate and solve 22 crimes, it has no application to routine traffic stops 23 associated with the enforcement of the Illinois Vehicle Code; 24 and 25 WHEREAS, It is in the best interest of the people of the 26 State of Illinois to have all officers trained in the same or 27 similar procedures for uniform and non-discriminatory 28 enforcement of Illinois vehicle and criminal laws; and 29 WHEREAS, The Illinois Law Enforcement Training Standards 30 Board is responsible for certifying and standardizing police 31 training curricula and academies throughout the State of -2- LRB9201416KBkbC 1 Illinois; therefore, be it 2 RESOLVED, BY THE SENATE OF THE NINETY-SECOND GENERAL 3 ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF 4 REPRESENTATIVES CONCURRING HEREIN, that the Illinois Law 5 Enforcement Training Standards Board shall convene a 6 committee within 60 days of the adoption of this joint 7 resolution, to study and evaluate all available uniform and 8 non-discriminatory traffic and criminal enforcement 9 procedures, including review of data collection methodologies 10 and models, for the purpose of presenting the Board a 11 recommendation for a model protocol or policy for uniform and 12 non-discriminatory enforcement of Illinois vehicle and 13 criminal laws, which would enhance current efforts in this 14 regard relating to academy and in-service training of all 15 police officers in the State of Illinois; and be it further 16 RESOLVED, That the committee be composed of members 17 appointed as follows: two members of the Illinois Senate, one 18 to be appointed by the President of the Senate, and one to be 19 appointed by the Senate Minority Leader, two members of the 20 Illinois House of Representatives, one to be appointed by the 21 Speaker of the House, and one to be appointed by the House 22 Minority Leader, one designee of the Illinois Law Enforcement 23 Training Standards Board who shall act as chairperson of the 24 committee, the Attorney General of the State of Illinois or 25 his designee, one police training academy director designated 26 by the Director of the Illinois Law Enforcement Training 27 Standards Board, and at least one designee from each of the 28 following organizations: the Policeman's Benevolent & 29 Protective Association of Illinois; the Illinois Fraternal 30 Order of Police; the Illinois State Police; the Illinois 31 Sheriffs' Association; the Illinois Association of Chiefs of 32 Police; the Illinois Police Association; and the Chicago 33 Police Department; and be it further -3- LRB9201416KBkbC 1 RESOLVED, That members of this committee shall serve 2 without compensation; and be it further 3 RESOLVED, The Board shall, after consideration of the 4 committee report, submit to the General Assembly, no later 5 than January 1, 2002, a report of actions taken which shall 6 include its recommendation for a model protocol or policy for 7 uniform and non-discriminatory enforcement of Illinois 8 vehicle and criminal laws; and be it further 9 RESOLVED, That all law enforcement agencies in this State 10 review their enforcement practices in light of the 11 recommendations in the Board's report; and be it further 12 RESOLVED, That suitable copies of this preamble and 13 resolution be presented to the Illinois Law Enforcement 14 Training Standards Board.
