Madigan 3 WHEREAS, Health care service contracts between insurers, 4 health plans, businesses, unions, health care professionals 5 and health care providers have become the primary method of 6 arranging for the delivery of health care to the people of 7 Illinois; and 8 WHEREAS, The Illinois General Assembly is currently 9 debating the Fairness in Health Care Services Contracting Act 10 which attempts to ensure that both parties to a contract for 11 the provision of health care services understand the terms 12 and conditions for the provision of those services; and 13 WHEREAS, The professional services contracts entered into 14 between health care plans and health care professionals and 15 health care providers have a significant impact on the 16 delivery of health care services to the people of Illinois; 17 and 18 WHEREAS, The relationship between the health care plan 19 contract with the professionals and providers is akin to the 20 insurance policy for coverage with the insureds or enrollees; 21 therefore, be it 22 RESOLVED, BY SENATE OF THE NINETY-SECOND GENERAL ASSEMBLY 23 OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES 24 CONCURRING HEREIN, that there is created the Illinois 25 Legislative Task Force on Fairness in Health Care Services 26 Contracting consisting of six voting members; two of whom 27 shall be members of the Senate appointed by the President of 28 the Senate, one of whom shall serve as Co-chairperson, one of 29 whom shall be a member of the Senate appointed by the 30 Minority Leader of the Senate, two of whom shall be members 31 of the House of Representatives appointed by the Speaker of 32 the House of Representatives, one of whom shall serve as 92SJ0033 Enrolled -2- LRB9208902RHrhB 1 Co-chairperson, one of whom shall be a member of the House of 2 Representatives appointed by the Minority Leader of the House 3 of Representatives; the Director of Insurance or his or her 4 designee, the Director of Public Health or his or her 5 designee, the Director of Public Aid or his or her designee, 6 and the Director of Central Management Services or his or her 7 designee shall serve as ex officio non-voting members of the 8 Task Force; and be it further 9 RESOLVED, That the Task Force shall include the following 10 non-voting members; including one representative of the 11 following organizations; Illinois Hospital and HealthSystems 12 Association, Illinois State Dental Society, Illinois Nurses 13 Association, Illinois Pharmacists Association, Illinois State 14 Medical Society, Illinois Podiatric Medical Society, Illinois 15 Optometric Association, Illinois Association of Clinical 16 Psychologists, Illinois Freestanding Surgery Center 17 Association, Chicago Federation of Labor, Illinois Municipal 18 League, American Association of Retired Persons, Employment 19 Law Council, Illinois Association of Health Plans, Managed 20 Health Providers Association, Illinois Life Insurance 21 Council, Blue Cross/Blue Shield of Illinois, Illinois Chamber 22 of Commerce, Illinois Manufacturers Association, Illinois 23 Retail Merchants Association, AFL/CIO, and the City of 24 Chicago; and be it further 25 RESOLVED, That the meetings of the Task Force shall be 26 held at the call of the Co-chairpersons and that the 27 non-voting members of the Task Force shall serve without 28 compensation; and be it further 29 RESOLVED, That the Task Force shall study the health plan 30 professional and provider services contracting process; and 31 be it further 32 RESOLVED, That the Task Force shall report its 92SJ0033 Enrolled -3- LRB9208902RHrhB 1 recommendations to the General Assembly and Governor on or 2 before January 15, 2002. 3 Adopted by the Senate, May 21, 2001. 4 _______________________ 5 President of the Senate 6 _______________________ 7 Secretary of the Senate 8 Concurred in by the House of Representatives, May 31, 9 2001. 10 _________________________ 11 Speaker of House of 12 Representatives 13 _________________________ 14 Clerk of House of 15 Representatives
