92_SJ0058eng 92SJ0058 Engrossed LRB9216224RHrh 1 SENATE JOINT RESOLUTION NO. 58 2 (As amended by Senate Amendment No. 1) 3 WHEREAS, Medical instruments are continuously being used 4 outside the medical or hospital setting by patients; and 5 WHEREAS, Many citizens have conditions, illnesses or 6 diseases that require the use of medical instruments such as 7 sterile hypodermic syringes or needles; and 8 WHEREAS, The Illinois laws concerning the availability 9 and use of medical instruments were enacted when most medical 10 procedures and treatments were done in an office or hospital 11 and do not address disease prevention; therefore, be it 12 RESOLVED, BY SENATE OF THE NINETY-SECOND GENERAL ASSEMBLY 13 OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES 14 CONCURRING HEREIN, that there is created the Commission on 15 Medical Instruments; this Commission shall review scientific 16 literature regarding availability of sterile hypodermic 17 syringes and needles and disease prevention and other 18 available information and make recommendation to the Illinois 19 General Assembly on appropriate standards for the sale and 20 possession of sterile hypodermic syringes and needles; and be 21 it further 22 RESOLVED, That the Commission shall include one 23 representative from the following organizations: Allied Waste 24 Industries, the AIDS Foundation of Chicago, the Chicago 25 Department of Public Health, the Cook County Department of 26 Public Health, the Cook County State's Attorney's Office, the 27 Illinois Academy of Family Physicians, Illinois Chapter, the 28 American Academy of Pediatricians, the Illinois Department of 29 Public Health, the Illinois Family Institute, the Illinois 30 Nurses Association, the Illinois Pharmacists Association, the 31 Illinois Public Health Association, the Illinois Retail 32 Merchants Association, the Illinois State Medical Society, 92SJ0058 Engrossed -2- LRB9216224RHrh 1 the Illinois Department of State Police, and the Illinois 2 State's Attorneys Association; and be it further 3 RESOLVED, That the Commission shall conduct at least 2 4 public hearings, one in Chicago and one in Springfield; and 5 be it further 6 RESOLVED, That the members of the Commission shall adopt 7 bylaws and elect a chairperson; members of the Commission 8 shall serve without compensation; the Illinois Department of 9 Public Health shall provide administrative support for the 10 Commission; and be it further 11 RESOLVED, That the Commission shall report its 12 recommendations to the General Assembly and Governor on or 13 before December 1, 2002.
