Provides that in addition to the currently authorized persons, the decedent's attorney under a power of attorney for health care, the decedent's surrogate decision maker under the Health Care Surrogate Act, the decedent's guardian of the person, any adult grandchild of the patient, or a close friend of the patient may consent to the donation of an anatomical gift by or the removal of corneal tissue from the decedent or patient. Establishes requirements for a determination that a person is a close friend of the patient. HOUSE AMENDMENT NO. 1. Deletes everything. Reinserts the original provisions of the bill, with changes. Provides that any adult grandchild or close friend of the decedent (rather than of the patient) may consent to the donation of an anatomical gift by or the removal of corneal tissue from the decedent. Establishes requirements for a determination that a person is a close friend of the decedent (rather than of the patient), including an affidavit presented to a representative of the hospital's designated organ procurement agency or tissue bank (rather than to the attending physician). Provides that any person authorized or under obligation to dispose of the body also may give consent to the donation of an anatomical gift or the removal of corneal tissue. HOUSE AMENDMENT NO. 2. Corrects a cross-reference. SENATE AMENDMENT NO. 1. Adds reference to: 20 ILCS 2310/2310-396 new Deletes everything. Reinserts the provisions of the engrossed bill, deleting the decedent's guardian of the person and a close friend of the decedent as persons who may be authorized to consent to an anatomical gift or the donation of corneal tissue from the decedent and moving the decedent's surrogate decision maker under the Health Care Surrogate Act from second to eighth in order of priority among those persons who may receive that authority. Provides that for the decedent's agent under a health care power of attorney to have that authority, the power of attorney must provide specific direction regarding organ donation. Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health shall establish an Organ Donation Task Force to study the various laws and rules regarding organ donation to determine whether consolidation or other changes in the laws or rules are needed to facilitate organ donation in Illinois.
