MCCARTHY-MATHIAS. (O'MALLEY) 735 ILCS 5/12-910 from Ch. 110, par. 12-910 Amends the Code of Civil Procedure. Makes a stylistic change in provisions concerning proceedings to enforce judgements. HOUSE AMENDMENT NO. 1. Adds reference to: 735 ILCS 5/12-911 from Ch. 110, par. 12-911 Amends the Code of Civil Procedure with regard to enforcement of judgments. Deletes provisions requiring the officer holding a certified copy of the judgment to summon 3 persons to be sworn as commissioners and to appraise the property. Provides that the judgment creditors or their heirs or assigns shall provide the officer with an appraisal of the property by a State certified general real estate appraiser or a State certified residential real estate appraiser. Provides that the sale of the property by the officer shall be subject to any existing encumbrances. Provides that the officer shall mail by certified mail or cause to be mailed by certified mail to the judgment debtor a notice indicating that the property will be sold unless the judgment is satisfied. The notice shall contain the date of the scheduled sale, which shall be no less than 60 days after the date of the notice. Effective immediately. SENATE AMENDMENT NO. 1.
