GRANBERG-LYONS,JOSEPH-BIGGINS-DURKIN. (RAUSCHENBERGER) New Act Creates the Mobile Telecommunications Sourcing Conformity Act. Contains a short title only. HOUSE AMENDMENT NO. 1. Adds reference to: 35 ILCS 630/2 from Ch. 120, par. 2002 35 ILCS 635/10 50 ILCS 750/15.3 from Ch. 134, par. 45.3 65 ILCS 5/8-11-2 from Ch. 24, par. 8-11-2 Deletes everything after the enacting clause. Creates the Mobile Telecommunications Sourcing Conformity Act. Provides that taxes on mobile telecommunications services shall be collected and remitted to the jurisdiction where the customer's primary use of the services occurs, irrespective of where the mobile telecommunications services originate, terminate, or pass through. Defines "place of primary use" as the street address representative of where the customer's use of the mobile telecommunications service primarily occurs, which must be (i) the residential street address or the primary business street address of the customer and (ii) within the licensed service area of the home service provider. Establishes mechanisms by which a home service provider of mobile telecommunications services may establish the taxing jurisdictions of a given street address. Provides that this Act applies to customer bills issued on or after August 1, 2002. Amends the Telecommunications Excise Tax Act, the Telecommunications Municipal Infrastructure Maintenance Fee Act, the Emergency Telephone System Act, and the privilege and occupation tax provision of the Illinois Municipal Code. Provides that as used in these Acts and this provision, with respect to wireless telecommunications, "service address" means the customer's place of primary use as defined in the Mobile Telecommunications Sourcing Conformity Act. Effective August 1, 2002. HOUSE AMENDMENT NO. 2. Removes language providing that the procedures and remedies set forth in the Act for customer complaints are the sole and exclusive remedy available to the customer and replaces it with provisions that these procedures shall be the first course of remedy available to customers, and that no cause of action based upon a dispute arising from these complaints or fees shall accrue until a customer has reasonably exercised these rights and procedures.
