HOFFMAN. New Act Creates the Academic Presentation Protection Act. Prohibits, except as authorized by policies developed by public institutions of higher education, a business, agency, or person, including an enrolled student, from preparing, causing to be prepared, giving, selling, transferring, or otherwise distributing or publishing for any commercial purpose any contemporaneous recording of an academic presentation by an instructor at a public institution of higher education. Provides that a circuit court may grant any relief that it finds necessary to enforce this Act, including the issuance of an injunction. Provides that a person injured by a violation of this Act, in addition to actual damages, may recover court costs, attorney's fees, and a civil penalty from a person other than an enrolled student. Requires each institution to develop policies to prohibit the unauthorized recording, dissemination, and publication of academic presentations for commercial purposes and to adopt rules governing a violation of this Act by students.
