ACEVEDO-OSTERMAN-FRITCHEY. 720 ILCS 5/24-1.7 new Amends the Criminal Code of 1961. Prohibits the manufacture, possession, and delivery of semiautomatic assault weapons, large capacity ammunition feeding devices, and assault weapons attachments. Provides that a person who lawfully possessed a semiautomatic assault weapon, large capacity ammunition feeding device, or assault weapon attachment may, within 90 days, register the weapon or device with the Department of State Police. Provides that a person has an affirmative defense to an alleged violation of these provisions if (i) he or she otherwise lawfully possessed or delivered the semiautomatic assault weapon, large capacity ammunition feeding device, or assault weapon attachment while in the performance of his or her official duties as a peace officer, correctional institution employee or official, or member of the Armed Services or Reserve Forces of the United States, or of the Illinois National Guard, or (ii) he or she is engaged in the manufacture of such weapon or device exclusively for such use pursuant to a contract or subcontract with a governmental body. CORRECTIONAL NOTE (Department of Corrections) House Bill 3690 would result from the provisions related to semiautomatic assault weapons, with an increase of two inmates and additional costs of $535,100 over ten years from the date of enactment. There may be additional increases for offenders sentenced for the large capacity ammunition feeding devices and assault weapon attachments provisions in this legislation.
