FRITCHEY. 205 ILCS 616/50 Amends the Electronic Fund Transfer Act. Provides that a surcharge for use of a terminal may not be imposed if the transaction does not affect an account held by the consumer with the owner or operator of the terminal and the transaction is conducted through a national or regional electronic banking network. Prohibits the imposition of fees upon a consumer for the use of a Link card or other access device used to obtain benefits under the Illinois Public Aid Code. FISCAL NOTE (Office of Banks and Real Estate) HB 3722 would not require any significant new resources or additional headcount and would create no fiscal impact on the Office of Banks and Real Estate (OBRE). The agency may receive some additional complaints and be required to make determinations on ATM ownership and whether or not a State bank or thrift violated the law. In limited instances, OBRE may conduct a visitation at a State bank and advise them that they need to correct the problem, but general compliance is anticipated among affected financial institutions.
