FORBY AND FOWLER. 720 ILCS 570/216 Amends the Illinois Controlled Substances Act. Prohibits the delivery in any single over-the-counter sale of more than 3 packages of any methamphetamine precursor drug or any combination of methamphetamine precursor drugs. Provides that a violation is a Class A misdemeanor for a first violation and a Class 4 felony for a second or subsequent violation. Establishes exemptions. JUDICIAL NOTE (Administrative Office of Illinois Courts) It has been determined that the bill would neither increase nor decrease the number of judges needed in the State. FISCAL NOTE (Illinois Department of Corrections) The impact on the Department is expect to be minimal. Each person sentenced to prison for a Class 4 felony would serve an average of six months at a cost of $10,319 and would require the construction of one additional prison bed at the cost of $50,510.
