        Amends the Illinois Food, Drug and Cosmetic Act.  Adopts  federal      
   regulations  concerning  food.   Authorizes  the  Department of Public      
   Health to establish and assess civil monetary penalties for violations      
   of  the  Act.   Provides  for  the  issuance  of  licenses   to   food      
   manufacturers,   processors,  packers,  and  warehouses  and  for  the      
   issuance of certain  certificates.   Preempts  home  rule  units  from      
   regulating  certain  food-related entities.  Makes these changes apply      
   on and after January 1, 2003.                                               
        HOUSE AMENDMENT NO. 1.                                                 
        In  provisions  relating  to  permits  for  food   manufacturers,      
   processors, packers, and warehouses, deletes the provisions specifying      
   certain  fees  in  connection  with required permits and certificates.      
   Provides instead that the Department of Public Health shall, by  rule,      
   establish a schedule of fees (i) for permit applications, permits, and      
   permit  renewals  for  food  manufacturers,  processors,  packers, and      
   warehouses  and  (ii)  for   certificates   of   free   sale,   health      
   certificates,  or  equivalents  for  food,  dairy,  drug, cosmetic, or      
   medical device manufacturers, processors, packers, and warehouses.          
        HOUSE AMENDMENT NO. 2.                                                 
          Deletes reference to:

          410 ILCS 620/21.4 new                                                
        Deletes everything after the enacting clause. Amends the Illinois      
   Food, Drug and Cosmetic Act. Provides that the  Department  of  Public      
   Health  is  authorized,  upon  request,  to issue certificates of free      
   sale, health certificates, or an equivalent, to Illinois food,  dairy,      
   drug,  cosmetic, or medical device manufacturers, processors, packers,      
   or warehousers, and requires the Department to establish a schedule of      
   fees. Provides that the Department shall issue an  Illinois  shellfish      
   certificate,  upon  request, to shellfish firms in compliance with the      
   Interstate  Shellfish  Sanitation  Conference.  Provides  that   these      
   amendatory provisions apply on and after January 1, 2003. Provides for      
   the  deposit  of  certificate  fees  and other moneys collected by the      
   Department under the Act into the Food and Drug Safety Fund.                
        SENATE AMENDMENT NO. 1.                                                
        Provides that the fee for a  certificate  of  free  sale,  health      
   certificate, or equivalent shall be $10 (instead of providing that the      
   Department  of  Public  Health  shall  establish a schedule of fees by      
   rule).
