WINKEL. (JACOBS-DONAHUE) 745 ILCS 10/2-302 from Ch. 85, par. 2-302 30 ILCS 805/8.26 new Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that if any claim or action is instituted against an employee of a local public entity based on an injury allegedly arising out of an act or omission occurring within the scope of his or her employment as such employee, the entity must indemnify the employee or former employee for his or her reasonable attorney's fees incurred in connection with the claim or action, except any portion incurred that relates to punitive or exemplary damages. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately. JUDICIAL NOTE (Illinois Courts Administrative Office) HB 4354 would neither increase nor decrease the number of judges needed in the State. HOUSE AMENDMENT NO. 1. Deletes reference to: 30 ILCS 805/8.26 new Deletes all changes. Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that a local public entity may indemnify an employee or former employee for attorney's fees incurred in defending a claim or action instituted against the employee based on an injury allegedly arising out of an act or omission occurring within the scope of employment.
