LANG-CROSS-OSMOND-MCKEON-MATHIAS, COULSON, SCULLY AND GARRETT. (SULLIVAN-PARKER-SILVERSTEIN-OBAMA) 215 ILCS 5/143.24c new 215 ILCS 5/154.6 from Ch. 73, par. 766.6 Amends the Illinois Insurance Code. Prohibits insurers from canceling, refusing to issue, or refusing to renew policies of insurance solely on the basis that one or more claims have been made against a policy during the preceding 60 months for a loss that is the result of a hate crime against the person or property of the insured if the policy is issued to certain religious, educational, or nonprofit organizations or if the policy is issued to an individual. Provides that a violation constitutes an improper claims practice. JUDICIAL NOTE (Illinois Courts Administrative Office) HB 4371 would neither increase nor decrease the number of judges needed in the State. HOUSE AMENDMENT NO. 1. Limits the prohibition on cancellation to situations where the perpetrator of the loss has been criminally prosecuted for the act causing the loss or the claim has been paid. SENATE AMENDMENT NO. 1. Deletes reference to: 215 ILCS 5/154.6 Adds reference to: 215 ILCS 5/424 from Ch. 73, par. 1031 Provides that the provision limiting the prohibition upon cancellation to situations in which the perpetrator of the loss is criminally prosecuted applies only if the insured provides evidence to the insurer that the act causing the loss is identified as a hate crime in a police report. Provides that a violation constitutes an unfair method of competition or deceptive practice rather than an unfair claims practice.
