MADIGAN,MJ-BURKE. 730 ILCS 5/5-8-1.2 Amends the Unified Code of Corrections. Makes a technical change to a Section concerning impact incarceration. HOUSE AMENDMENT NO. 1. Deletes reference to: 730 ILCS 5/5-8-1.2 Adds reference to: 55 ILCS 5/4-8002 from Ch. 34, par. 4-8002 30 ILCS 805/8.26 new Deletes everything after the enacting clause. Amends the Counties Code. Provides for stipends to be paid to the sheriff of Cook County and those employees of the sheriff responsible for administering the county impact incarceration program. The first year's stipends are to be paid by Cook County. Thereafter, the stipends are to be paid by the State. Preempts home rule powers. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately. HOME RULE NOTE, H-AM 1 HB 5922 (H-am 1) pre-empts home rule authority. STATE MANDATES NOTE, H-AM 1 (Illinois Department of Commerce and Community Affairs) In the opinion of DCCA, HB 5922 (H-am 1) creates a personnel mandate for which reimbursement of 100% of the increased costs to units of local government would normally be required. However, HB 5922 (H-am 1) amends the State Mandates Act to re- quire implementation by Cook County without State reimburse- ment in the first year. The estimated cost to the county is $93,000. FISCAL NOTE, H-AM 1 (Illinois Department of Commerce and Community Affairs). HB 5922 (H-am 1) does not contain a reference to DCCA. However, for FY2002, DCCA was allocated $663,000 for sheriffs' stipends. The legislation incurs impact on local revenue by requiring Cook County to pay stipends for one year to its Sheriff and those employees of the Sheriff responsible for administering the county's impact incarceration program. Subsequent years' stipends shall be paid by the State. The legislation does not specify a funding source for the stipends in the State budget. Cook County will pay $93,000 in stipends for one year. The State shall be required to allocate $31,000 for the stipends each year thereafter.
