CULLERTON-OBAMA-MUNOZ-LIGHTFORD. (O'BRIEN-LANG-GARRETT-NOVAK-CURRY,JULIE) New Act Creates the Drug Court Treatment Act. Permits the chief judge of each judicial circuit to establish a drug court program. Provides that the prosecutor and the defendant may agree that the defendant may be admitted to the program with the approval of the court. Contains provisions concerning eligibility for the program, assessment of defendants, and operation of the program. Provides that the program shall include a regimen of graduated requirements and rewards and sanctions, including but not limited to: fines, fees, costs, restitution, incarceration, individual and group therapy, drug analysis testing, close monitoring for a minimum of 30 days and supervision of progress, educational or vocational counseling as appropriate, and other requirements necessary to fulfill the drug court program. Sets forth dispositional options for defendants who successfully complete the program and those who fail to do so. SENATE AMENDMENT NO. 1. Provides that the chief judge may determine the manner in which a defendant is admitted into a drug court program. Eliminates provision requiring the prosecutor to agree to the defendant's admission into a drug court program. Also eliminates provision that the prosecutor must agree that the defendant is addicted to or of using drugs before the court orders an assessment of the defendant. Adds a definition of "drug court professional" to the Act. Provides that a defendant shall be excluded from a drug court program if the defendant has previously completed or has been discharged from a drug court program. Provides that a defendant admitted into a drug court program may be incarcer- ated up to 180 days. Provides that the close monitoring of the defendant may be by the court at a minimum of once every 30 days.
