CULLERTON. 740 ILCS 110/3 from Ch. 91 1/2, par. 803 Amends the Mental Health and Developmental Disabilities Confidentiality Act. Provides that psychological test material may not be disclosed without a court order based on a finding that there is clear and convincing evidence to believe that the psychological test instrument is inherently discriminatory on the basis of race, color, religion, or another characteristic. (Under current law, such material may not be disclosed if disclosure would compromise the objectivity or fairness of the testing process.) Effective immediately.
