Short description: 
CHILD PASSENGER-40-80 POUNDS                                               

Synopsis of Bill as introduced:
        Amends the Child Passenger Protection Act.  Provides  that  every      
   person, when transporting a child 4 years of age and older weighing 40      
   pounds  or  more  but  not more than 80 pounds in certain vehicles, is      
   responsible for securing that child in a  child  booster  seat  and  a      
   federally  approved  lap-and-shoulder  belt  system. Provides that the      
   parent or legal guardian of the child must  provide  a  child  booster      
   seat  to  any  person who transports his or her child. Provides that a      
   person who transports the child of another is not in violation of  the      
   provision  unless  a  child booster seat was provided by the parent or      
   legal guardian but was not used to transport the child. Does not apply      
   if the vehicle used to transport the child  is  not  equipped  with  a      
   federally approved lap-and-shoulder belt system. Provides that failure      
   to  secure  the  child  as  required  does not constitute contributory      
   negligence and is not admissible as evidence in the trial of any civil      
   action.                                                                     
        HOUSE AMENDMENT NO. 1.                                                 
        Provides that the requirements apply when the child is 4 years of      
   age or older but under the age of 10 and weighs 40 pounds or more but       
   not more than 80 pounds or is less than 4 feet 9 inches in height.          
        HOUSE AMENDMENT NO. 2.                                                 
        Provides that every person, when transporting a child at least  4      
   years  of  age  but  under  12  years  of  age in certain vehicles, is      
   responsible for securing that child in  seat  safety  belts  or  in  a      
   federally  approved  lap-and-shoulder  belt  system and a booster seat      
   designed for a child weighing 40 or more pounds but not more  than  80      
   pounds  or  a  child  less than 4 feet 9 inches in height (rather than      
   providing that every person transporting a child 4  years  of  age  or      
   older  but  under the age of 10 and weighing 40 pounds or more but not      
   more than 80 pounds, or a child 4 years of age or older but  under  10      
   years  of  age and less than 4 feet 9 inches in height, is responsible      
   for securing that child in a booster seat  and  a  federally  approved      
   lap-and-shoulder  belt  system).  Deletes  language providing that the      
   parent or legal guardian of the child must provide a booster  seat  to      
   any person who transports the child. Deletes language providing that a      
   person  who transports the child of another is not in violation of the      
   provision unless a booster seat was provided and was not used. Deletes      
   language providing that the provision does not apply  if  the  vehicle      
   used  to transport the child is not equipped with a federally approved      
   lap-and-shoulder belt system.
