House Sponsors: LINDNER-WIRSING. Short description: RAILROAD LAND ACQUISITION Synopsis of Bill as introduced: Amends the Railroad Incorporation Act and the Illinois Vehicle Code. Provides that a railroad corporation may acquire through eminent domain proceedings title to real estate necessary for the location of depots, station buildings, repair shops, or mainline right of way (rather than for those purposes and for location of any right of way, for purposes of the railroad's incorporation or the transaction of its business, or for any lawful purpose connected with the building, operating, or running of the railroad). Establishes procedures to be followed when the Illinois Commerce Commission receives an application for a certificate of public convenience and necessity allowing a railroad carrier to acquire real estate by eminent domain. Provides that if any portion of the amendatory Act is found to be invalid, that portion's invalidity shall not affect the enforceability or validity of the remainder of the Amendatory Act. Deletes language providing for acquisition by quick take proceedings of land for the construction of an industrial harbor railroad port adjacent to the Illinois River. Effective immediately.
