House Sponsors: SMITH,MICHAEL. Senate Sponsors: SHADID-HAWKINSON Short description: MUNI CD-ZONING JURISDICTION Synopsis of Bill as introduced: Amends the Illinois Municipal Code. Provides that a municipality located in a county that has adopted a zoning ordinance and the county that adopted the ordinance may enter into an intergovernmental agreement that allows the municipality to exercise its zoning powers beyond the municipality's territorial limits. Provides that the intergovernmental agreement must be limited to the territory within the municipality's zoning jurisdiction. HOUSE AMENDMENT NO. 1. Further amends the Illinois Municipal Code. Provides that an intergovernmental agreement between a county and a municipality may not authorize the municipality to exercise its zoning powers outside of the corporate limits of the municipality with respect to land used for agricultural purposes. SENATE AMENDMENT NO. 1. Further amends the Illinois Municipal Code. Provides that a municipality with a population of more than 112,000 located in a county with a population of less than 185,000 that has adopted a zoning ordinance (instead of a municipality located in a county that has adopted a zoning ordinance) may enter into an intergovernmental agreement that allows the municipality to exercise its zoning powers beyond its territorial limits. Requires the municipality and the county to amend their individual zoning maps in the same manner as other zoning changes are incorporated into the maps. Adds an immediate effective date. GOVERNOR'S AMENDATORY VETO MESSAGE Recommends the bill be amended as follows: Provides that the zoning powers to which a participating municipality is limited with respect to agriculutral land are those powers possessed by a county, rather than a municipality, under the Counties Code.
