Senate Sponsors: MADIGAN,L Short description: COMPUTER LEMON ACT Synopsis of Bill as introduced: Creates the Computer Lemon Act and amends the Consumer Fraud and Deceptive Business Practices Act. Establishes rights for purchasers of defective computer devices, protecting them from warranty abuses and ineffective warranty repairs. Imposes certain record keeping requirements on manufacturers. Establishes a right of action and remedies for purchasers against manufacturers who do not comply with Act requirements. Provides that a knowing violation of the Computer Lemon Act constitutes an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. FISCAL NOTE (Office Of the Attorney General) Initial annual cost of $40,000 in salaries, benefits and opera- ting costs for one additional Consumer Advocate to handle medi- ation of the expected additional volume of complaints. HOUSE AMENDMENT NO. 1. Provides that the written statement of the purchaser's rights shall be provided by the manufacturer. Deletes provisions requiring the disclosures of software likely to cause problems to be made at the time of sale of the computer.
