Senate Sponsors: MADIGAN,L Short description: HEIRLOOM MARRIAGE CERTIFICATES Synopsis of Bill as introduced: Amends the State Finance Act, the Vital Records Act, and the Illinois Marriage and Dissolution of Marriage Act. Provides that an heirloom marriage certificate shall be issued by the State Registrar of Vital Records upon request and upon payment of a fee to be determined by the State Registrar. Provides that $25 of the fee shall be deposited into the Affordable Housing Fund, a new special fund in the State treasury. Provides that moneys in the Fund shall be used solely for reimbursement to counties for the costs of preparing and issuing heirloom marriage certificates and for grants for affordable housing programs. Sets forth various requirements for heirloom marriage certificates. STATE DEBT NOTE (Economic and Fiscal Commission) HB 1935 would not affect the bonding authorization of the State, and, therefore, has no direct impact on the level of State indebtedness. HOUSING AFFORDABILITY NOTE (Housing Development Authority) There is no fiscal effect on a single-family residence. FISCAL NOTE (Economic and Fiscal Commission) HB 1935 would not affect the fiscal operations of the Illinois Economic and Fiscal Commission. HOUSE AMENDMENT NO. 1. Deletes reference to: 30 ILCS 105/5.541 new 410 ILCS 535/25 Adds reference to: 55 ILCS 5/3-2010.5 new 55 ILCS 5/3-11010.5 new Deletes everything. Amends the Counties Code and the Illinois Marriage and Dissolution of Marriage Act. Provides that the clerk in counties with a population over 2,000,000 may issue an heirloom marriage certificate. Provides that the fee for an heirloom marriage certificate shall be determined by the State Registrar, and shall include the cost of production and issuance of the heirloom marriage certificate and an additional sum of $25. Provides that $25 of the fee for the certificate shall be transferred to the county treasurer for deposit into a County Affordable Housing Fund established by the county treasurer. Provides that moneys in the Fund shall be used for grants for affordable housing programs in the county. Provides that not less than 50% of the moneys shall be used as grants to municipal- ities of over 500,000 for affordable housing programs in those munici- palities. Requires the Director of Public Health to prescribe the forms for the heirloom marriage certificate. Adds an immediate effective date.
