          New Act
Deletes everything. Creates the Public Employee Candidacy Act.
Prohibits a public employer from penalizing a public employee through
termination of employment, forced resignation, invalidation of
transfer, demotion, reprimand, or other means because of the
employee's candidacy for a public office. Conditions the prohibition
upon the employee's notification of the employer of his or her
candidacy. Requires a notified employer to request an advisory
opinion from the U.S. Office of Special Counsel as to whether the
employee is subject to the federal Hatch Act and to inform the
employee as to the opinion. Requires the employer to offer to an
employee subject to the federal Hatch Act an equivalent position that
is not subject to that Act. Provides that the Act's prohibition does
not apply to an employee who remains in a position subject to the
federal Hatch Act. Requires public employers to keep their new and
current employees informed of these provisions. Defines public
employee to include State and local government employees. Effective
   immediately.
