House Sponsors: LYONS,EILEEN. Short description: CRIM CD-ELDERLY-DISABLED Synopsis of Bill as introduced: Amends the Criminal Code of 1961. In provisions concerning the offense of criminal neglect of an elderly or disabled person, eliminates a requirement of consideration in the definition of "caregiver" and eliminates the provision that "caregiver" does not include a nursing home or related facility or a person licensed under the Medical Practice Act of 1987. In provisions concerning the offense of theft by deception, adds persons with disabilities as specified victims of the offense (in addition to persons age 60 or older) and provides that if the offender obtained money or property valued at $100,000 or more, the offense is a Class 1 (rather than Class 2) felony. In provisions concerning the offense of financial exploitation of an elderly person or person with a disability, eliminates the requirement that the offender obtain control over the person's property by deception or intimidation; provides that a person stands in a position of trust and confidence with an elderly person or person with a disability when he or she misrepresents his or her status as being a relative, being a joint tenant or tenant in common, or having a legal or fiduciary relationship.
