Senate Sponsors: WALSH,T-PARKER-JONES,E-RADOGNO Short description: PROFESSIONAL COUNSELOR LICNSNG Synopsis of Bill as introduced: Amends the Professional Counselor and Clinical Professional Counselor Licensing Act. Removes the restriction that required every member, partner, or employee to hold a valid license under this Act in order for the partnership or association to be licensed. Provides that fees imposed under the Act shall be set by rule. Provides that the Board may compel an applicant or licensee who has possibly violated the Act to submit to a mental and physical examination. Provides that the Board must require individuals unable to practice because of violations under this Act to submit to care, counseling, or treatment or in lieu of care, counseling, or treatment, the Board may recommend that the Department file a complaint to suspend or revoke the license of the individual. Repeals the implementation and transitional period Section. Amends the Regulatory Sunset Act. Changes the repeal date from December 31, 2002 to January 1, 2013. Effective immediately. HOUSE AMENDMENT NO. 2. Adds reference to: 225 ILCS 107/10 225 ILCS 107/15 225 ILCS 107/21 new 225 ILCS 107/30 from Ch. 111, par. 8451-30 225 ILCS 107/45 Deletes everything after the enacting clause. Amends the Regulatory Sunset Act to extend the repeal of the Professional Counselor and Clinical Professional Counselor Licensing Act. Amends the Professional Counselor and Clinical Professional Counselor Licensing Act. Makes changes in provisions concerning definitions, the exemption for students, interns, and residents, unlicensed practice, and qualifications for a license. Provides a civil penalty for unlicensed practice. In provisions concerning the Professional Counselor Examining and Disciplinary Board, (i) deletes provisions concerning the initial appointees to the Board, (ii) provides that a majority of the Board members currently appointed shall constitute a quorum, and (iii) provides that members of the Board shall have no criminal, civil, or professional liability in an action based upon a disciplinary proceeding or other activity performed in good faith as a member of the Board, except for willful or wanton misconduct. Provides that fees shall be set by rule (rather than specified in statute). Adds rendering professional counseling or clinical professional counseling services without a license or practicing outside the scope of a license and clinical supervisors failing to adequately and responsibly monitor supervisees to the grounds for discipline under the Act. Provides that the Board may compel a licensee or applicant to submit to a mental or physical examination, or both. Repeals a provision of the Professional Counselor and Clinical Professional Counselor Licensing Act concerning implementation of the Act and transitional periods. Effective immediately.
