House Sponsors: FLOWERS-DAVIS,MONIQUE. Short description: CD CORR-PRISONERS-AIDS Synopsis of Bill as introduced: Amends the Juvenile Court Act of 1987 and the Unified Code of Corrections. Provides that a person committed to a correctional institution of the Department of Corrections, including the Juvenile Division, shall, upon admission to the facility, be given written information on the causes and effects of acquired immunodeficiency syndrome (AIDS), the means of detecting AIDS and preventing its transmission, the availability of counseling and medical treatment for AIDS, the right of a committed person infected with AIDS to medical treatment, and such other information on AIDS as the Department deems appropriate. Provides that each person committed to a Department of Corrections facility (rather than just individuals convicted of certain sex offenses and offenses under the Hypodermic Syringes and Needles Act) shall be tested for AIDs. Provides that biological materials or other bodily fluids taken from the committed person may not be used for DNA profiling or any purpose other than for a determination of whether the person has AIDS. Requires a person released from a Department of Corrections facility to receive certain written information on health facilities that test for and treat persons infected with AIDS. Provides that a person who is committed to a correctional institution of the Department of Corrections shall be tested for AIDS within 90 days of release from the institution. Provides that a committed person who tests positive for AIDS shall receive from the Department appropriate medications for treatment of AIDS. Provides that a parole officer who is aware that a person released from a correctional institution has AIDS shall monitor the person released to determine that the person is taking prescribed medications for AIDS and is not engaging in activity that could infect other persons with AIDS. CORRECTIONAL NOTE (Department of Corrections) Over the next ten years, testing costs would be $48,464,016 and treatment costs would be $91,392,180 for a total of $139,856,196 for testing and treatment. There are other pro- visions which will have minimal or no impact on the Department. HOUSE AMENDMENT NO. 1. Deletes reference to: 705 ILCS 405/5-750 730 ILCS 5/3-6-2 730 ILCS 5/3-14-1 730 ILCS 5/5-5-3 Adds reference to: New Act Deletes everything. Creates the HIV/AIDS Prevention Program for Department of Corrections Offenders, Significant Others, and Family Act. Provides that the Department of Corrections and the Department of Public Health shall jointly develop and implement an HIV/AIDS prevention education program targeted to offenders incarcerated in Department of Corrections facilities, significant others, and family of adult and juvenile prison inmates. Provides that the Illinois Department of Corrections shall: (1) provide, in all public waiting rooms of detention facilities and prisons, printed information on the transmission and prevention of HIV/AIDS, hepatitis C, and other sexually transmitted diseases and referral information to community-based-providers of HIV/AIDS prevention, HIV/AIDS treatment, and HIV/AIDS counseling and testing services throughout Illinois; (2) display in all public waiting rooms of detention facilities and prisons an HIV/AIDS informational video, produced by a national organization with expertise in HIV/AIDS prevention; (3) provide written information on the transmission and prevention of HIV/AIDS, hepatitis C, and other sexually transmitted diseases to all inmates upon entrance to a detention center or prison and offer voluntary HIV/AIDS testing to all inmates; and (4) provide written information on the transmission and prevention of HIV/AIDS, hepatitis C, and other sexually transmitted diseases to all inmates just prior to their release from custody and referral to appropriate community based organizations that provide HIV/AIDS services and HIV/AIDS counseling and testing. Provides that one year after implementation of this Act, the Illinois Department of Corrections shall report to the Illinois General Assembly on the effectiveness of this program in increasing voluntary HIV/AIDS testing.
