Senate Sponsors: PARKER Short description: DHS-COMMUNITY SRVICES-PUBLIC $ Synopsis of Bill as introduced: Amends the Community Services Act. Provides that if public moneys are paid for the support of an individual who resides in an institution, and if that individual becomes a recipient of community services under the Act upon his or her discharge from that institution, the Department of Human Services must ensure that the amount of public moneys paid for the support of that individual in the community-services setting is not less than the amount of public moneys paid for the support of that individual in the institutional setting. HOUSE AMENDMENT NO. 1. Deletes reference to: 405 ILCS 30/4.05 new Adds reference to: 405 ILCS 30/4.4 new 405 ILCS 30/4.5 new Deletes everything. Amends the Community Services Act. Provides that whenever any appropriation, or any portion of an appropriation, for any fiscal year relating to the funding of any State-operated facility operated by the Office of Developmental Disabilities within the Department of Human Services or any mental health facility operated by the Office of Mental Health within the Department is reduced because of any of the following reasons, those moneys must be kept within the funding system from which they came: (1) closing of a State-operated facility; (2) reduction of the number of beds in a State-operated facility; (3) reduction in the number of staff at a State-operated facility; or (4) reduction in the qualifications required of staff at a State-operated facility. Provides for the appointment of a Funding Reinvestment Advisory Task Force to assist the Department of Human Services in implementing these provisions. Effective immediately. HOUSE AMENDMENT NO. 2. Deletes everything. Amends the Community Services Act by adding provisions similar to those added by House Amendment No. 1, with changes that include the following: (1) adds statements of purposes in connection with the provisions concerning funding reinvestment; (2) provides that savings resulting from reduced appropriations for mental health or developmental disabilities facilities must be directed toward providing other services and supports for persons with develop- mental disabilities or mental health needs; (3) eliminates a reduction in the qualifications of staff employed in mental health or develop- mental facilities as a factor generating such savings; (4) eliminates provisions concerning a limit on reductions in appropriations for mental health services; (5) adds members to the Funding Reinvestment Advisory Task Force; (6) adds functions for the task force; and (7) requires that the task force be established by June 1, 2002 and requires a report by January 1, 2003.
