House Sponsors: O'BRIEN-REITZ. Senate Sponsors: PARKER Short description: HWY CD-ROAD DISTRICT SPENDING Synopsis of Bill as introduced: Amends the Illinois Highway Code. Provides that the township board of trustees shall assume all taxing authority of a township road district abolished because of a reduction in the total mileage of the township road system to 4 miles or less. Provides that a road district may organize or participate in recycling programs and may use moneys in its district road fund for recycling. Provides that the road district commissioner must obtain the permission of the county engineer before using tax moneys on construction or maintenance projects costing more than $10,000 (rather than more than $5,000). Increases from 20% to 50% the percentage of motor fuel tax moneys that a road district may spend on eligible nondedicated subdivision roads. Effective immediately. FISCAL NOTE (Department of Transportation) This bill has no fiscal impact on the Department. HOME RULE NOTE (Department of Commerce and Community Affairs) HB 4365 does not contain language indicating a limitation of home rule powers and functions. Therefore, in the opinion of DCCA, HB 4365 does not pre-empt home rule authority. SENATE AMENDMENT NO. 1. Deletes reference to: 605 ILCS 5/6-132 new Deletes language regarding road district organization of and participation in recycling programs and use of district road fund moneys to pay for those programs.
