Senate Sponsors: JACOBS-DONAHUE Short description: ENVIRONMENTAL PROTECTION-SITE Synopsis of Bill as introduced: Amends the Petroleum Underground Storage Tanks Title of the Environmental Protection Act. Replaces the system of physical soil classification, groundwater investigation, and site classification for leaking underground storage tanks with a system of site investigation and corrective action. Provides that, as a part of this system, the owner or operator must submit various documents, including a site investigation plan, a site investigation budget (for owners and operators seeking payment from the Underground Storage Tank Fund), a site investigation completion report, a corrective action plan, a corrective action budget (for owners and operators seeking payment from the Underground Storage Tank Fund), and a corrective action completion report. Increases the maximum amount that an owner or operator of 101 or more tanks in Illinois may be paid from the Underground Storage Tank Fund for costs of corrective action during a calendar year to $3,000,000. Provides that the Agency shall not pay costs associated with a corrective action plan incurred after the Agency provides notification to the owner or operator that a revised corrective action plan is required. Provides that for purposes of payment for early action costs, fill material shall not be removed in an amount in excess of 4 feet from the outside dimensions of an underground storage tank. Effective immediately. HOUSE AMENDMENT NO. 1. Provides that investigations, plans, and reports conducted or prepared under the Section concerning leaking underground storage tank site investigations shall be conducted by a licensed professional engineer and in accordance with the requirements of this Title. HOUSE AMENDMENT NO. 2. Increases from $1,000,000 to $2,000,000 the maximum amount the Agency may approve from the Underground Storage Tank Fund in a calendar year for corrective action or indemnification to an owner or operator with fewer than 101 tanks. Increases from $1,000,000 to $1,500,000 the maximum amount per occurrence the Agency may approve from the Fund for corrective action or indemnification.
