Senate Sponsors: KARPIEL-MADIGAN,L-HALVORSON-LAUZEN-O'MALLEY Short description: CRIM CD-SEX OFFENSES Synopsis of Bill as introduced: Amends the Criminal Code of 1961. Eliminates the statute of limitation for any offense involving sexual conduct or sexual penetration in which the DNA profile of the offender is obtained whether or not that DNA profile identifies a named individual. Effective immediately. HOUSE AMENDMENT NO. 2. Provides that the extended period for the prosecution of offenses involving sexual conduct or sexual penetration in which the DNA profile of the offender is obtained applies only if the victim reported the offense to law enforcement authorities within 2 years after the commission of the offense unless a longer period for reporting the offense to law enforcement authorities is provided by law. SENATE AMENDMENT NO. 1. Provides that prosecution of an offense involving sexual conduct or sexual penetration may be commenced at any time if the DNA profile of the offender is obtained and entered into a DNA database within 10 years after the commission of the offense and the identity of the offender is unknown after a diligent investigation by law enforcement authorities (rather than whether or not the DNA profile identifies a named individual).
