Provides that the prohibition against driving on the sidewalk does not apply to an electric personal assistive mobility device. Defines such a device as a self-balancing 2 non-tandem wheeled device designed to transport only one person with an electric propulsion system with average power of 750 watts (one horsepower), whose maximum speed on a paved level surface, when powered solely by a propulsion system of that type while ridden by an operator weighing 170 pounds, is less than 20 miles per hour. HOME RULE NOTE (Department of Commerce and Community Affairs) HB 5610 does not contain language indicating a limitation of home rule powers and functions. Therefore, in the opinion of DCCA, HB 5610 does not pre-empt home rule authority. SENATE AMENDMENT NO. 1. Adds reference to: 625 ILCS 5/11-1005.1 new Deletes everything. Amends the Illinois Vehicle Code. Reinserts the provisions of the original bill. Further provides that a person operating an electric personal assistive mobility device has all the rights and is subject to all the duties applicable to a pedestrian. SENATE AMENDMENT NO. 2. Adds reference to: 625 ILCS 5/11-1412.2 new Deletes everything. Amends the Illinois Vehicle Code. Reinserts the provisions of the original bill and Senate Amendment No. 1 with certain changes. Changes the definition of the device to a self-balancing 2 non-tandem wheeled device designed to transport only one person with an electric propulsion system that limits the maximum speed of the device to 15 miles per hour or less. Further provides that a person may not operate the device on a public sidewalk at a speed greater than 8 miles per hour. GOVERNOR'S AMENDATORY VETO MESSAGE Adds reference to: 625 ILCS 5/11-208.2 Recommends that the legislation be amended to specifically pro- vide that the amendatory Act does not limit or preempt the authority of any home rule or non-home rule unit of local government to regulate or prohibit the use of electric personal assistive mobility devices.
