House Sponsors: TURNER,ART-JONES,LOU. Short description: CRIM PRO-UNPAID COSTS Synopsis of Bill as introduced: Amends the Code of Criminal Procedure of 1963. Provides that the clerk of the court may add a delinquency amount fee to the unpaid fines and unpaid costs of conviction of a convicted person equal to an amount of 5% of the unpaid fines and costs that remain unpaid after 30 days, 10% of the unpaid fines and costs that remain unpaid after 60 days, and 15% of the unpaid fines and costs that remain unpaid after 90 days. Provides that after 90 days delinquency, the clerk may release that information of delinquency to credit reporting agencies. FISCAL NOTE (Office of Illinois Courts) The fiscal impact of HB 5713 cannot be estimated because the number of cases subject to a court-ordered payment schedule is unknown, and the number of cases affected would vary by county. JUDICIAL NOTE (Office of Illinois Courts) HB 5713 would neither increase nor decrease the number of judges needed in the State. FISCAL NOTE, H-AM 1 (Office of Illinois Courts) HB 5713 would generate additional revenues in the Circuit Court of Cook County. The dollar amount of the impact cannot be determined because the number of cases affected is unknown. STATE MANDATES NOTE, H-AM 1 (Illinois Department of Commerce and Community Affairs) In the opinion of DCCA, HB 5713 (H-am 1) does not create a State mandate under the State Mandates Act.
