Senate Sponsors: GEO-KARIS-PARKER-LIGHTFORD-HALVORSON-TROTTER Short description: END STAGE RENAL DISEASE FAC Synopsis of Bill as introduced: Creates the End Stage Renal Disease Facility Act. Provides for the licensure of facilities that provide dialysis treatment or dialysis training to individuals with end stage renal disease. Provides for administration and enforcement of the new Act by the Department of Public Health. Amends the State Finance Act by creating the End Stage Renal Disease Facility Licensing Fund. Effec- tive January 1, 2003. HOUSE AMENDMENT NO. 1. Deletes everything after the enacting clause. Reinserts the bill as introduced with the following changes: (i) removes the definition of "licensee"; (ii) provides that existing end stage renal disease facilities shall obtain a valid license to operate within one year after the adoption of rules to implement the Act (rather than one year after the effective date of the Act); (iii) makes changes in provisions concerning exemption from licensure, minimum staffing requirements, minimum standards, inspections, denial, suspension, revocation, or refusal to renew a license, information available for public inspection, the End Stage Renal Disease Advisory Committee, and adoption of rules; (iv) adds provisions concerning notice of violations, plans of correction, notice of administrative actions, receiving and investigating reports, judicial review, fines, and injunctions; and (v) makes other changes. Effective immediately. SENATE AMENDMENT NO. 1. Defines "licensee". Adds a facility licensed under the Nursing Home Care Act to the list of facilities exempted from the licensing requirements of the Act. Provides that the Department shall adopt rules for determining the fines for violation of the Act. Changes the term hearing officer to administrative law judge. Adds physicians assistants and advanced practice nurses to the minimum staffing requirements for end stage renal disease facilities. Changes the effective date to July 1, 2003. SENATE AMENDMENT NO. 2. Removes a facility licensed under the Nursing Home Care Act from the list of licensing exemptions.
