Requires county sheriffs to adopt and implement a written policy that provides for the release of persons in the custody of the sheriff to other law enforcement personnel or the State's Attorney for the purpose of furthering investigations into criminal matters. Provides that the sheriff is not liable for any injury to the person released or to a third party during the period that the person released is in the custody of other law enforcement personnel or the State's Attorney, unless the sheriff or a deputy sheriff, correctional guard, lockup keeper, or county employee is guilty of willful and wanton conduct that proximately caused the injury. Effective immediately. SENATE AMENDMENT NO. 1. Deletes the provisions concerning the release of prisoners. Amends the County Jail Act. Reinserts the provisions of the bill as introduced. Provides that the county sheriff may adopt and implement a written policy for the release of a person in the custody of the sheriff to law enforcement personnel or the State's Attorney for the purpose of furthering criminal investigations that are unrelated to the matter for which the person is in custody (instead of for the purpose of furthering criminal investigations). Sets minimum require- ments for a policy for the release of persons in custody to law enforcement personnel and the State's Attorney. FISCAL NOTE (Office of Illinois Courts) There would be no fiscal impact on the judicial branch. FISCAL NOTE (Illinois State Police) SB 21 would have no fiscal impact on the Illinois State Police.
