House Sponsors: FRANKS-GARRETT-OSMOND-ZICKUS-MATHIAS Short description: VEH CD-INSPECTION DAMAGE-SUIT Synopsis of Bill as introduced: Amends the Emission Inspection Chapter of the Ilinois Vehicle Code. Provides that the owner of a vheicle damaged by or because of an emission inspection may bring a civil action in the circuit court of the county in which the inspection occurred against the contractor who performed the inspection. Provides for recovery of triple damages, costs, and attorney's fees. Effective immediately. HOUSE AMENDMENT NO. 1. Adds reference to: 625 ILCS 5/13B-25 Deletes everything. Reinserts the provisions of the original bill with changes. Provides that the owner may bring a civil action against the contractor in accordance with the Illinois Code of Civil Procedure (rather than providing for recovery of triple daages, costs, and attorney's fees). Deletes language pertaining to inspections conducted in calendar year 1995. Further amends the Emission Inspection Chapter of the Illinois Vehicle Code. Specifies certain inspection procedures that shall be followed on model year 1996 and newer vehicles equipped with OBDII on-board computer diagnostic equipment, if authorized by the U.S. Environmental Protection Agency and the Pollution Control Board or the Illinois Environmental Protection Agency. Provides that if a vehicle is damaged by the contractor in performing an emission inspection, the owner of the vehicle may bring a civil action against the contractor in the circuit court of the county in which the inspection occurred in accordance with the provisions of the Illinois Code of Civil Procedure.
