Senate Sponsors: RADOGNO. House Sponsors: LYONS,EILEEN-ZICKUS Short description: VEH CD-DEALERS-NEW KEY ISSUED Synopsis of Bill as introduced: Amends the Illinois Vehicle Code. Provides that other than at the time of sale of the vehicle, no vehicle dealer may issue to any person a new key to a vehicle unless the person can prove that he or she is the owner of that vehicle by the certificate of title or the vehicle registration card. Effective immediately. SENATE AMENDMENT NO. 1. Deletes the amendatory provisions of the original bill and reinserts them with changes. Provides that the new provisions do not apply at the time of repossession (as well as not applying at the time of sale) of the vehicle. Provides that the requirements of the new provisions are satisfied if the person presents the purchase documents and finance contract or the rental or lease agreement (as well as if the person presents the certificate of title or the motor vehicle registration card). Provides that the vehicle dealer must make a copy of the driver's license or State identification card of the person requesting the newly created key and must retain the copy for 6 months. Provides that a vehicle dealer who violates these requirements is guilty of a petty offense. Provides that a violation is not cause to suspend, revoke, cancel, or deny renewal of the vehicle dealer's license. SENATE AMENDMENT NO. 2. Provides that (in addition to the other permitted methods) the vehicle dealer may verify ownership of the vehicle by contacting the vehicle dealer from whom the vehicle was purchased to confirm that the person requesting the newly created key is the person who purchased the vehicle. FISCAL NOTE (Department of Transportation) Passage of SB 115 will cause no fiscal impact to IDOT. HOUSE AMENDMENT NO. 2. Deletes the amendatory provisions of the bill as amended and reinserts them with changes. Provides that the only requirement of the new provisions is that the dealer must make a copy of the person's driver's license or State identification card and retain the copy for 30 days.
