Senate Sponsors: O'MALLEY. Short description: RR CROSSING DELAY LIABILITY Synopsis of Bill as introduced: Creates the Rail Carrier Crossing Delay Liability Act. Provides that if a rail carrier's train or other equipment blocks a public highway, road, or street at a location where the carrier's railroad track crosses the highway, road, or street, so that pedestrian or vehicular traffic on the highway, road, or street is unable to cross the track for more than 20 minutes, the rail carrier is liable in a civil action for all damages of any type proximately caused by the delay. Provides that the carrier is not liable, however, if the blockage or delay was due to circumstances beyond the rail carrier's control. Provides for minimum liquidated damages of $500, and authorizes the recovery of punitive damages. Effective immediately.
