Makes a technical change concerning direct deposit of payments. SENATE AMENDMENT NO. 1. Deletes reference to: 15 ILCS 405/9.03 Adds reference to: 30 ILCS 210/5 from Ch. 15, par. 155 30 ILCS 500/50-11 new 30 ILCS 500/50-60 Deletes everything. Amends the Illinois State Collection Act of 1986. Provides that State agencies may use the Comptroller's Offset System to determine if any State agency is attempting to collect debt from a contractor, bidder, or other proposed contracting party. Amends the Illinois Procurement Code. Provides that no person shall submit a bid for or enter into a contract with a State agency under this Code if that person knows or should know that he or she is delinquent in the payment of any debt to the State, unless the person has entered into a deferred payment plan to pay off the debt. Provides that every bid submitted to and contract executed by the State shall contain a certification by the bidder or contractor that the contractor is not barred from being awarded a contract under these provisions and that the contractor acknowledges that the contracting State agency may declare the contract void if the certification is false. Provides that if, during the term of a contract, the contracting agency determines that the contractor is delinquent in the payment of a debt to the State, the State agency may declare the contract void if it determines that voiding the contract is in the best interests of the State. Effective July 1, 2002. HOUSE AMENDMENT NO. 1. (Tabled May 22, 2001) In the Illinois Procurement Code, removes language providing that the Debt Collection Unit shall adopt rules to implement the authori- zation that State agenices may void contracts with contractors who are delinquent State debtors. Provides that the chief procurement officer shall adopt rules as to the factors to be considered in determining whether voiding a contract with a delinquent State debtor is in the State's best interest. Requires the Debt Collection Board to adopt rules to define delinquent payment of a debt, rather than determine the phrase's meaning.
