Senate Sponsors: JONES,W. House Sponsors: BRUNSVOLD-REITZ-JONES,JOHN-FOWLER Short description: VEH CD-SEIZED PROPERTY-RETURN Synopsis of Bill as introduced: Amends the Illinois Vehicle Code. Provides that if a court orders a law enforcement agency to return a vehicle or part that was seized because its manufacturer's identification number was removed, altered, defaced, or destroyed, the vehicle or part must be returned in the same condition it was in at the time of seizure. HOUSE AMENDMENT NO. 1. Deletes everything. Amends the Illinois Vehicle Code. Provides that if a motorcycle is seized because the motorcycle or any part of the motorcycle has had its manufacturer's identification number removed, altered, defaced, or destroyed, the motorcycle must be returned within 45 days of seizure to the person from whom it was seized, unless criminal charges are pending against that person, an application for an order of forfeiture has been submitted to the circuit in the county of seizure, or the circuit court in the county of seizure has received from the seizing law enforcement agency and has granted a single 30 day extension of the 45 day deadline. The motorcycle must be returned in essentially the same condition it was in at the time of seizure, except that the law enforcement agency is not required to replace any part or parts removed from the motorcycle after being found to be stolen.
