Senate Sponsors: MOLARO. Short description: CRIM PRO-PROSECUTOR MISCONDUCT Synopsis of Bill as introduced: Amends the Code of Criminal Procedure of 1963. Provides that the court may declare a mistrial in a capital case on the grounds of a prosecutor's misconduct during trial that the court determines is sufficiently material to affect the reliability of the verdict. Allows a motion to declare a mistrial during the course of the trial. Provides for sanctions against a defendant's counsel who makes such a motion other than in good faith. Effective immediately.
