In provisions concerning the findings and recommended order of a hearing officer that are filed with the Illinois Human Rights Commission, provides that the findings and recommended order need not be authored by the hearing officer who presides at a public hearing if (i) all parties agree, or (ii) the presiding hearing officer transmits his or her impression of witness credibility to the author, or (iii) there are no questions of witness credibility. (Under current law, all 3 conditions must be satisfied.) HOUSE AMENDMENT NO. 1. Replaces the provisions concerning the authorship of findings and a recommended order by a hearing officer other than the hearing officer who presides at a public hearing. Authorizes authorship by such a hearing officer if (1) the hearing officer who presides at the public hearing is unable to author the findings and recommended order by reason of death, disability, or separation from employment and (2) all parties to a complaint file a joint motion agreeing to such authorship. (Under current law, the findings and recommended order need not be authored by the presiding hearing officer if (i) all parties agree, (ii) the presiding hearing officer transmits his or her impression of witness credibility to the author, and (iii) there are no questions of witness credibility.)
