House Sponsors: HOFFMAN-HOLBROOK-JEFFERSON-DAVIS,MONIQUE-HOWARD Short description: ENVRNMNTL PROTECTION-BROWNFLDS Synopsis of Bill as introduced: Amends the Environmental Protection Act. Repeals the Brownfields Site Restoration Program and recreates that program in provisions containing the Brownfields Redevelopment Loan Program. Provides that the fees for eligibility reviews conducted by DCCA and for review of remediation costs and the budget plan conducted by IEPA must be deposited into the Brownfields Redevelopment Fund (now, must be deposited into the Brownfields Site Restoration Program Fund). Any moneys remaining in the Brownfields Site Restoration Program Fund on the effective date of this amendatory Act of the 92nd General Assembly shall be transferred to the Brownfields Redevelopment Fund. Provides that moneys in the Brownfields Redevelopment Fund may be used for the purposes of the Brownfields Site Restoration Program, including payment for the costs of administering the Program. Amends the State Finance Act. Eliminates the Brownfields Site Restoration Program Fund. Effective immediately. SENATE AMENDMENT NO. 1. Adds reference to: 415 ILCS 5/58.3 415 ILCS 5/58.13 Deletes everything after the enacting clause and reinserts language from the introduced bill. Amends the Environmental Protection Act. Provides that the Agency is authorized to administer funds made available to the Agency under federal law for brownfield cleanup activities. Limits grant amounts given under the Municipal Brownfields Redevelopment Grant Program to a maximum of $240,000. Adds remedial action plans and remedial completion reports to the list of activities eligible for moneys under the Municipal Brownfield Redevelopment Program. HOUSE AMENDMENT NO. 1. In the provisions concerning the Brownfields Site Restoration Program, provides that the application fee for eligibility reviews must be made payable to the Department of Commerce and Community Affairs for deposit into the Workforce, Technology, and Economic Development Fund (rather than the Brownfields Redevelopment Fund), and the fees shall be used by the Department for the administrative expenses of the program.
