Short description: 
PREMISES LIABILITY ACT                                                     

Synopsis of Bill as introduced:
        Amends the Premises Liability Act.  Provides  that  an  owner  or      
   operator   of  an  off-road  riding  facility,  a  facility  used  for      
   recreational  activities  or  sporting  events  involving  off-highway      
   vehicles, is not criminally liable for any noise emission and  is  not      
   subject to a nuisance or trespass action based on noise emissions.          
        SENATE AMENDMENT NO. 1.                                                
        Provides that an  off-road  riding  facility  is  a  thoroughfare      
   across  land  or snow used for off-highway motorcycles (as well as for      
   all-terrain vehicles).                                                      
        HOUSE AMENDMENT NO. 1.                                                 
        Provides that immunity  from  a  civil  action  for  nuisance  or      
   trespass  does  not  apply  if  there  is willful or wanton misconduct      
   outside the normal use of the off-road riding facility.                     
        HOUSE AMENDMENT NO. 4.                                                 
        Provides that an off-road riding facility is  not  subject  to  a      
   nuisance  or  trespass  action  if  the  facility was the recipient of      
   grants under the Recreational Trails of Illinois Act or  the  facility      
   is operated by a governmental entity.                                       
        GOVERNOR'S AMENDATORY VETO MESSAGE                                     
        Recommends that the bill be amended to delete language providing       
   that the owner of an off-road riding facility in existence on January       
   1, 2002 is immune from any criminal liability for noise emmissions          
   arising out of normal activity. Deletes language providing that the         
   owner of an off-road riding facility in existence on January 1, 2002        
   is immune from criminal and civil liability for nosie or sound emis-        
   sions if certain conditions are met. Provides that the new provision        
   applies only to causes of action accruing on or after the effective         
   date of the amendatory Act.
