Senate Sponsors: WEAVER. House Sponsors: HANNIG Short description: BUDGET IMPLEMENTATION-FY2003 Synopsis of Bill as introduced: Creates the FY2003 Budget Implementation Act. Provides that the purpose of the Act is to make the changes in State programs that are necessary to implement the Governor's FY2003 budget recommendations. HOUSE AMENDMENT NO. 2. Adds reference to: 230 ILCS 10/2.1 new 230 ILCS 10/4 from Ch. 120, par. 2404 230 ILCS 10/7 from Ch. 120, par. 2407 230 ILCS 10/11.3 new 230 ILCS 10/11.4 new 230 ILCS 10/13.2 new Deletes everything. Creates the FY2003 Budget Implementation (Gaming) Act. Provides that the purpose of the Act is to make changes in State programs relating to gaming that are necessary to implement the State's FY2003 budget. Amends the Riverboat Gambling Act. Expands the Mississippi River licenses to authorize the location of riverboats in a municipality that (1) borders the Mississippi River or is within 5 miles of the city limits of a municipality that borders on the Mississippi River and (2) has a riverboat conducting riverboat gambling operations on the effective date. Changes the definition of "riverboat" to include permanently moored barges that are permanently fixed together. Increases the owners license renewal fee from $5,000 per year to $50,000 per year. Imposes a 10% supplemental tax on annual adjusted gross receipts in excess of $200,000,000. Provides that the proceeds from this tax shall be paid into the Education Assistance Fund. Provides that the Board shall reallocate a portion of the gaming positions of a licensee that conducts riverboat gambling from a home dock in Rock Island County to certain owners licensees. Authorizes certain owners licensees to use the gaming positions authorized by an owners license under which riverboat gambling operations are not being conducted on the effective date of this amendatory Act. Provides that an owners licensee that receives an owners license authorizing it to begin conducting riverboat gambling operations on or after the effective date of this amendatory Act must attain a level of at least 20% minority person and female ownership, at least 16% and 4% respectively. Provides that the Board must (rather than may) issue 10 owners licenses. Amends Public Act 91-40 to replace that Act's inseverability clause with a severability clause. Effective immediately. PENSION IMPACT NOTE, H-AM 2 (Illinois Pension Laws Commission) SB 2289, as amended by H-am 2, would not affect the accrued liabilities or annual cost of any Illinois public pension fund or retirement system. STATE MANDATES FISCAL NOTE, H-AM 2 (Department of Commerce and Community Affairs) In the opinion of DCCA, SB 2289 (HA #2) does not create a State mandate under the State Mandates Act. FISCAL NOTE, H-AM 2 (Illinois Gaming Board) Based on actual 2001 adjusted gross receipts and an additional 400 gaming positions for each of the licensees of Grand Vic- toria (Elgin), Empress (Joliet), Harrah's (Joliet), and Holly- wood (Aurora), H-AM 2 would generate an additional $141.8 million annually.
