AN ACT concerning safety.
|
Be it enacted by the People of the State of Illinois,
|
represented in the General Assembly:
|
Section 5. The Illinois Underground Utility Facilities |
Damage Prevention Act is amended by changing Section 14 as |
follows:
|

Sec. 14. Home rule. The regulation of underground utility |
facilities
and CATS facilities damage prevention, as provided |
for in this Act, is an
exclusive power and function of the |
State. A home rule unit may not
regulate underground utility |
facilities and CATS facilities damage
prevention, as provided |
for in this Act. All units of local government,
including home |
rule units that are not municipalities of more than 1,000,000 |
persons, must comply with the provisions of this Act. To this |
extent, this This
Section is a denial and
limitation of home |
rule powers and functions under subsection (h) of
Section 6 of |
Article VII of the Illinois Constitution. A home rule |
municipality of more than 1,000,000 persons may regulate |
underground utility facilities and CATS facilities damage |
prevention.
