AN ACT concerning public aid.
|
Be it enacted by the People of the State of Illinois,
|
represented in the General Assembly:
|
Section 5. The Illinois Public Aid Code is amended by |
changing Section 5-5.1 as follows:
|
(305 ILCS 5/5-5.1) (from Ch. 23, par. 5-5.1)
|
Sec. 5-5.1. Grouping of Facilities. The Department of |
Healthcare and Family Services shall, for purposes of payment, |
provide for
groupings of nursing facilities. Factors to be |
considered
in grouping facilities may include, but are not |
limited to,
size, age, patient mix, percentage of Medicaid |
funded residents, or geographical area.
|
The groupings developed under this Section shall be
|
considered in determining reasonable cost reimbursement
|
formulas. However, this Section shall not preclude the
|
Department from recognizing and evaluating the cost of
capital |
on a facility-by-facility basis.
|
A resident of a nursing facility whose application for long |
term care benefits is awaiting final action shall be included |
in the calculation as a Medicaid funded resident. |
